i 1 <br /> Amendment No. 1 to GC/CM Contract <br /> Ara, General Contractor/Construction Manager Services for <br /> Water Pollution Control Facility Expansion <br /> Phase Cl (Liquid Stream) <br /> F. Section 1.15 of the Contract is amended to read as follows: <br /> 1.15 Total Contract Cost: "Total Contract Cost" (TCC) means the amount <br /> specified on page 1 of this GC/CM Contract that the Owner agrees to pay the <br /> GC/CM for performance and completion of the Work in accordance with the <br /> Contract Documents. The Total Contract Cost consists of the Fixed Amount for <br /> the Specified General Conditions work, Project Contingency, the Maximum <br /> Allowable Construction Cost and the Percent Fee Amount. The TCC shall be <br /> • organized by the items, categories and costs set forth in Attachment 2, "Phase <br /> Cl Total Contract Cost Summary". <br /> G. Insert Section 1.17 into the Contract as follows: <br /> 1.17 Project Contingency: A "Project Contingency" has been established, as <br /> specified on page 1 of this GC/CM Contract. The Project Contingency shall be <br /> owned and controlled by the Owner, and may be authorized for use on the <br /> Project authorized only at the sole discretion of the Owner as described in <br /> General Conditions 1.01A 31. Notwithstanding any other provisions in the <br /> Contract Documents, the GC/CM shall have no right to use or expect to use <br /> funds included in the Project Contingency. Funds remaining in the Project <br /> Contingency at the end of the Project shall be returned to the Owner through a <br /> deductive Change Order. <br /> H. Section 5.3 of the Contract is amended to read as follows: <br /> 5.3. Substantial Completion: All Work required by the Contract Documents <br /> shall be substantially complete within 760 calendar days of March 3, 2014 which <br /> is the date specified in the Notice to Proceed to begin Work. Final Completion <br /> shall be accomplished within 90 calendar days of Substantial Completion. <br /> I. Section 6.1.1 of the Contract is amended to read as follows: <br /> 6.1.1. Documentation. A Phase Cl Total Contract Cost Summary is included in <br /> the Contract as Attachment 2, dated March 2014. A complete and detailed cost <br /> breakdown for Total for Subcontract Costs is included in the Contract as <br /> Attachment 3, dated March 3, 2014.
