right, but not the obligation, to remove from the Premises all personal property located <br /> therein and to store the same in any place selected by Lessor, including but not limited <br /> to public warehouse, at the expense and risk of the owners thereof, with the right to sell <br /> such stored property after it has been stored for a period if sixty days or more, with <br /> fifteen written days notice to Lessee, the proceeds of such sale to be applied first to the <br /> costs of the sale, second to the payment of charges of storage, if any, and third to the <br /> payment of any other sums of money which may be due from Lessee to Lessor under <br /> the terms hereof; the balance, if any, shall be paid to the Lessee. <br /> 22. NON-WAIVER. It is agreed that no waiver by Lessor of any breach by <br /> Lessee of any covenant, agreement or provision herein shall be construed as a waiver <br /> of any subsequent breach of the same or any other covenant or provision. <br /> 23. CONDITION at TERMINATION. Lessee agrees that at the termination of <br /> this lease agreement the Premises will be returned to Lessor in as good condition and <br /> state of repair as when the Premises were leased, ordinary and reasonable wear and <br /> tear excepted. Nothing herein shall prohibit Lessee from removing all fixtures and <br /> equipment installed therein, whether or not attached to the real estate, provided that the <br /> Lessee shall restore or repair any damages to the Premises caused thereby. <br /> 24. NOTICES. Any written notice required to be served in accordance with <br /> the terms of this lease agreement shall be delivered in person, or shall be sent by <br /> certified mail, return receipt requested, and if mailed shall be deemed to have been <br /> given one day following the date the envelope is postmarked. Notices, if mailed, shall <br /> be sent by Lessee to Lessor at Lessor's last known address, and by Lessor to Lessee <br /> at the leased Premises. <br /> 25. HOLDING OVER. If Lessee should hold over and continue to use the <br /> Premises after the expiration of the term of this lease agreement, such tenancy shall be <br /> for an indefinite period of time on a month-to-month basis, which may be terminated by <br />
