levied against the Premises for each year during the term of the lease. Lessee <br /> shall pay for all licenses, fees and occupational taxes covering the business <br /> conducted on the Premises, all taxes and levies on property of Lessee on the <br /> Premises and any and all other taxes and charges relating to the Premises <br /> resulting from operation of Lessee's business thereon. <br /> 11. CASULTY INSURANCE. Lessee agrees to keep the Premises fully <br /> insured against loss or damage by fire and other perils insurable under a <br /> standard form of insurance; in the event that Lessor obtains the insurance policy, <br /> Lessee agrees to reimburse Lessor for the costs of such insurance after the <br /> receipt from Lessor of a statement showing the premium paid. Lessee agrees to <br /> keep all tenant fixtures, equipment and other personal property fully insured. It is <br /> agreed that neither party shall be liable to the other for any damage by fire or <br /> other perils covered by insurance due to any cause whatsoever, except <br /> intentional damage; each waives the right to subrogation against the other for <br /> losses paid by insurance, to the extent that they may do so without impairment of <br /> their respective insurance policies. <br /> 12. FIRE or OTHER CASULTY. In the event the Premises are damaged or <br /> destroyed by fire or other casualty, Lessee shall give Lessor immediate written <br /> notice thereof. If the damage by fire or casual is less than fifty percent (50%) of <br /> the value of the improvements, Lessor shall use due diligence to repair the <br /> same, and during such period the rental of the Premises shall be abated in the <br /> same ratio that the portion of the improvements rendered for the time being unfit <br /> for occupancy shall bear to the whole of the leased improvements. If the damage <br /> is fifty percent (50%) or more of the value of the improvements, it shall be <br /> optional with Lessor to rebuild or repair the same, which option shall be <br /> exercised not more than thirty (30) days after Lessor is notified in writing by <br /> Lessee of the damage or destruction. If Lessor fails to give notice within such <br /> thirty (30) days, Lessee shall have the right to declare this lease agreement <br />
