terminated by written notice served upon the Lessor. If the damage by fire or <br /> casualty is such that the Premises are wholly untenable, and the Lessor elects to <br /> repair or replace the same, the rental provided for herein shall cease until such <br /> time as the Premises shall have been completely repaired or rebuilt. Lessor <br /> agrees to use reasonable diligence, without unreasonable delay, in such <br /> repairing or rebuilding. If the Premises cannot be repaired within one hundred <br /> twenty (120) days from the date of the fire or other casualty, Lessee may elect to <br /> terminate the lease. <br /> 13. LIABILTY INSURANCE. Lessee agrees to obtain and maintain a policy <br /> of liability insurance insuring against all claims of or actions for damage suffered <br /> or alleged to be suffered in or about the Premises, fully covering the risks of loss <br /> or damage to persons or to property. The limits of such policy shall not be less <br /> than $2 million. Lessor shall be named as an additional insured upon such policy <br /> and Lessee shall furnish Lessor with a certificate evidencing that Le See has <br /> obtained such a policy. <br /> 14. HOLD HARMLESS. Lessee agrees to indemnify, hold harmless and <br /> defend Lessor, including the payment of all reasonable attorney fees and costs, <br /> from any claim, loss or liability arising out of or related to any activity of Lessee <br /> on the Premises, or any condition of the Premises, whether or not covered by <br /> insurance. <br /> 15. EMINENT DOMAIN. If the whole or such portion of the Premises as to <br /> render the remaining portion untenable for the purpose for which Lessee has <br /> been using the Premises, shall be taken by any public or governmental authority <br /> under the power of eminent domain, then the terms of this lease shall cease as <br /> of the date possession is taken by such authority and the rent shall be paid up to <br /> that date. If only part of the leased Premises shall be taken and the remainder <br /> not so taken remains tenable for the purpose for which Lessee has been using <br /> 4l�/ <br />
