The activities of residents walking or riding bicycles to and from the <br /> building on bike paths or other walkways do not rise to the level of a nuisance. <br /> Emergency service is not a nuisance. The City in its staff report submitted that the laws, as set forth in the EMC and <br /> State law, "provide sufficient enforcement mechanisms should any nuisance <br /> related activity such as drug related activity, harassment or loitering occur". <br /> The City's position is that remedies exist for such activities and that speculation <br /> of social or psychological impacts are not a consideration. (exhibit 1, staff <br /> report, page 19; testimony of Ms. McCrary) <br /> 63. CHS has enacted a policy that will address behaviors for the residents of the <br /> facility. All residents will be required to sign a "good neighbor policy" form. <br /> According to CHS, this acknowledgement will assist it in responding to <br /> unwanted street behaviors that are set forth in a resident's lease agreement. <br /> Among the items that will be covered in the "good neighbor policy" are: <br /> • no littering or loitering in the neighborhood; <br /> • no yelling or fighting on the property, sidewalks or in the neighborhood; <br /> • no bringing in unauthorized guests through any entry that is not the main <br /> entrance; <br /> • no hassling neighbors, store vendors, etc.; <br /> • no aggressive panhandling in the neighborhood; and <br /> • no purchasing or selling drugs or drug paraphernalia in the neighborhood. <br /> (exhibit 1, staff report, page 19; exhibit 9, draft management plan, page 5; <br /> testimony of Ms. McCrary; testimony of Mr. Tippy; testimony of Mr. Rice) <br /> 64. In exhibit 1, staff report - pages 19 and 20, the City listed Comprehensive Plan <br /> objectives, goals and polices that are applicable to the instant application. <br /> These include Land Use Objectives and Policies; Land Use Designations - <br /> Locational Criteria; Housing Policies; Housing Objectives; and Climate Change <br /> and Sustainability Policies. The citations and compliance, as set forth in pages <br /> 19 and 20 of the staff report, exhibit 1, are from the Everett General Plan. <br /> According to the City, the proposal is consistent with all of these objectives, <br /> goals and policies. (exhibit 1, staff report, pages 19 and 20) <br /> 65. The proposed project addresses public health, safety and welfare by providing <br /> decent, safe and sanitary housing for individuals who now live in public places <br /> not suitable for habitation. It is located in an area where living amenities and a <br /> significant regional transportation network are nearby. Adequate access to <br /> these facilities will be provided for pedestrian and bicycle use. The <br /> public/quasi-public land use designation'of the site in the General Plan supports <br />
