98. Testimony was received that sirens from emergency vehicles to and from the <br /> site would be disruptive. CHS submitted that there may be an increase of <br /> emergency vehicles that serve the site, but on-site services will be available to <br /> accommodate the health care systems provided to the residents in a more <br /> efficient manner. (exhibit 17, comments from public and staff response, page <br /> 4; testimony of Ms. McCrary) <br /> 99. Concern was submitted that the facility will not be inspected and that code <br /> enforcement will not be provided. The City has a Code Enforcement Unit that <br /> is responsive to complaints regarding building and City code violations. The <br /> proposed facility will be subject to annual inspections by the Everett Fire <br /> Department and will have to comply with the Federal Housing Quality <br /> Standards if the facility receives federal funds. (exhibit 17, comments from <br /> public and staff response, page 4; testimony of Ms. McCrary; testimony of Mr. <br /> Hall) <br /> 100. Testimony was received that the site may lose its natural barrier and slope <br /> protection and that the visibility will make this site more obvious. The City in <br /> response submitted that there is a recommended condition of landscaping <br /> along the west-facing sloped hillside area between City property and the <br /> commercial business at the bottom of the slope. The landscaping will improve <br /> sight lines in the area and make it less attractive for unwanted activities. <br /> (exhibit 17, comments from public and staff response, page 5; testimony of Ms. <br /> McCrary) <br /> CONCLUSIONS OF LAW <br /> Jurisdiction <br /> Jurisdiction: . The Hearing Examiner of the City of Everett has jurisdictional authority <br /> to hold a hearing and to issue the decision. That authority is set forth in EMC <br /> 15.16.100. Based on the above Findings of Fact, the Hearing Examiner enters the <br /> following Conclusions: <br /> Criteria and Standards for Review <br /> Short Subdivision — EMC 18.28.010 Evaluation Criteria <br /> A. Public Use and Interest-The proposed project and design shall promote the <br /> public use and interest in accordance with the standards established by the <br /> State, City, and this Ordinance; <br /> B. Public health, safety, and general welfare - The proposed project and design <br /> shall promote the public health, safety and general welfare in accordance with <br /> the standards established by the State, City, and this Ordinance; <br /> C. Comprehensive Plan - The proposed project and design is consistent with the <br /> City's Comprehensive Plan policies and land use map; <br /> 22‹.) <br />
