Previous or current personal or professional relationships with a <br /> 5 key member of any party directly or indirectly involved. <br /> 6 I 7 e. Previous and current service as a Board member on projects <br /> 8 where any of the parties directly or indirectly involved in this <br /> 9 Contract were also involved. <br /> 10 <br /> 11 f. Any prior involvement in this project. <br /> 12 I 13 Within 14 calendar days of receiving the resumes and disclosure statements <br /> 14 from the Board nominees, the Contracting Agency and the Contractor shall <br /> 15 review and jointly agree on the final selection of the three members to serve on <br /> 16 the Board. In the event that any of the three nominees are not acceptable to 1' <br /> 17 either party, the process shall be repeated until all positions are filled. <br /> 18 <br /> 19 The Contracting Agency, the Contractor, and the Board shall execute the Three- I <br /> 20 Party Agreement not later than the first Board meeting. The Three-Party <br /> 21 Agreement form (WSDOT Form 134-091) is available online at WSDOT <br /> 22 Electronic Forms webpage. <br /> 23 <br /> 24 The Board shall determine and notify the parties which Board member will act <br /> 25 as the Board chair. <br /> 26111 <br /> 27 Disputes Review Board Candidates <br /> 28 The qualifications of some potential Board members have been reviewed <br /> 29 and deemed potentially acceptable by the Washington State Department of <br /> 30 Transportation (WSDOT). This list of potential Board members, Statewide <br /> 31 Prequalified DRB Candidate Roster, is available from the WSDOT <br /> 32 Headquarters Construction Office website at I <br /> 33 https://www.wsdot.wa.gov/business/construction/dispute-review-boards. <br /> 34 Either party may propose a Board nominee that is not on the WSDOT list. <br /> 35 In either case, Board nominees must comply with the requirements of the I <br /> 36 Board Member Qualifications, Board Member Ongoing <br /> 37 Responsibilities, and Establishment of the Board subsection of this <br /> 38 Special Provision, and every Board member must be deemed acceptable <br /> 39 by both the Contracting Agency and the Contractor. <br /> 40 <br /> 41 Replacement or Termination of a Board Member <br /> 42 Procedures for terminating Board members are defined in The Three-Party <br /> 43 Agreement. <br /> 44 <br /> 45 Disputes Review Board Procedures — General I <br /> 46 The Board, Contracting Agency, and Contractor may mutually develop rules of <br /> 47 operation of the Board that supplement the Three-Party Agreement.
