218 <br /> June 10,1992 <br /> previously held a public hearing on March 18, 1992; a split <br /> vote (3-3) failed to approve or deny the applicant's request, <br /> which, by default, remanded the request-to the Planning <br /> Commission without further instructions. <br /> The Planning Commission held a8eand public hearing on May 5 <br /> 1992, at which they reviewedthe City Council record and <br /> e <br /> adopted a solution recommending that the rezone bedenied, <br /> but stated that the proposed land use designation for.Mr.. <br /> Warnock's one lot would be again reviewed for the larger Colby <br /> Avenue <br /> corridor during the update of the city's comprehensive <br /> plan. <br /> Staff recommends c with the recommendation of the <br /> Planning Commission deny theD <br /> -application to amen the Land Use <br /> Map of the Everett General Plan:however, he told Council that <br /> if they wished to.approve the application a resolution was <br /> included in their packet doing this. A change in circumstances <br /> to allow a commercial building in a residential zone must be <br /> proved. <br /> A letter from Mancy Monson and Gary Bold, 1412 20th Steadt, <br /> opposing this application ras read Into the record. <br /> Reid Shockey, 2924 Colby, planning consultant representing Mr. <br /> Warnock raised a concern that his letter of January 25,1992 to <br /> Paul Roberts, Planning was not included.:in.Councils packet. <br /> He proceeded to read it into the record. He further pointed <br /> out that protection for the neighborhood could be allowed and <br /> that it was <br /> not the intent of his client t0 change the <br /> character of the house. He said his client could not sell this <br /> property as <br /> commercial but only as multiple family. He further <br /> told Council that the newcomp plan does have s mall spots <br /> that vary from the designated plan. He said the City is not <br /> oder any mandate to review this by July, 1993 under the Growth <br /> Management Act. Mr. Shockey felt that this segment of Colby <br /> has been in a constant state of evolution and change. He <br /> recommended Council to approve Resolution B which approves the <br /> application of Dan Warnock to amend the land use map of the <br /> Everett General Plan for the property located at 1930 Colby <br /> Avenue. <br /> Moved by Councilmen Pope, seconded by Councilman Diamond is <br /> dram the public hearing. <br /> Allan Giffen, Planning, madeseral clarifications: 1) <br /> Resolution of Intent not presented to the Planning <br /> Commission but was described; 2) the Planning Commission <br /> indicated at the second hearing that they felt there was no new <br /> O <br />
