January 26,2000 <br /> Dave Koenig noted that the City Council has a memo dated January 21,2000 <br /> from Paul Roberta and himself with a new resolution of inert to rezone which <br /> includes Exhibits H and C(alternate)and also a memo dated January 25.1999 <br /> from Craig Fullerton,Jim Iles and himself with some recommended changes <br /> regarding the Safeway Comp Plan ordinance,resolution of intern,and Terrace <br /> Drive Vacation ordinance. Thom changes are as follows: 1)For de street <br /> vacatthn ordinance,insert the following sentence at the end of Section 3:"Said <br /> payment shall be made no later pan thirty(30)days following receipt and <br /> acceptance of the appraisal by the City's Real Property Division."In Section <br /> 12 of the Street Vacation ordinance,replace the dam of"February If,2000' <br /> with-July 19,2000.'2)In Section 2 of the Comp Plan Ordinance,replace the <br /> date of"Febmuy I2,2000'with"July 19,2000. Also rote that there is a <br /> typo in the 4a lire of that section of the Comp Plan Ordinance.It sbald read <br /> "void at such time.. 3)For the Resolution of Intent add a new section, <br /> "Semioa 3,"to read as follows: "Thin this Resolution shall not become <br /> effective unless and until the City Council approves the vacation of Terrace <br /> Drive between 4a"Street and 42•Street. In the evert the City does tot <br /> approve said vacation prior to July 19,2000,then this resolution shall become <br /> null <br /> on of a street <br /> vacation ordinnancet byh <br /> hthe Eve.City Coouncil which mdinaoncs).means the e then become <br /> effective." <br /> Presldem Campbell asked Safeway repmenatives to give a brief presentation <br /> addressing the issue that Council previously raised concerning the proposal. <br /> Tom Walsh,Safeway representative,introduced Mitch Johmon,Safeway;Paul <br /> 'Nrrmtla,architect;and Jim Dale,assisting with the presentation. <br /> Mr.Walsh sated that new information would be presented as well as a response <br /> to Council concerts.He respectfully requested that a decision be made today. <br /> Proposed new zoning conditions are as follows: Section 2.6-increase of <br /> landscape buffer from PO feet to 12 feet and upgrade landscaping from Type <br /> to Type M;Section 7.4-delivery vehicle motors shall be turned off when <br /> vehicles art parked at the sore and signs shall be posted;Section 7.5- <br /> deliveries to store shall be limited to hours of 5 a.m,to ll p.m.;Section S- <br /> maintenance of property and landscaping and putt control addressed;Section <br /> 8.2.1--t assunme device shall be provided in amount Ota less than 300%of <br /> 32 <br />
