June 25,2003 <br /> Roll was called with all council members vogng yes except Council <br /> Member Krell who was excused. <br /> Motion carried. <br /> Moved by Councq Member Pope,se onded by Council Member <br /> Campbell to adapt Resolution No.5352 adopting the Annual <br /> Transportation Improvement Program(TIP)update for 2004 to 2009 <br /> for the City of Everett. <br /> Roll was called with all council members voting yes except Council <br /> Member Krell who was excused. <br /> Mogen carried. <br /> ND PROTEST APPEAL <br /> Peter Camp,City Attorney's Office,explained that before City Council is <br /> the matter of the bid protest involving Bid No.2003-557,Shotcrete <br /> Phases 2A and 2 B of the Everett Water PollutionControl Facility project. <br /> There wase mandatory pre bid tour on May 13.commencing at 9 a.m. <br /> Finishing Edge,the apparent low bidder arrived 1530 minutes late.Bids <br /> were opened May 20,2003 and Finishing Edge was the low bidder. <br /> Precision Earthworks was 2n°low bidder. Precision Earthworks has <br /> protested the City's intent to award the contract to Finishing Edge <br /> because they say they did not appear for the mandatory pre-bid. The <br /> committee met and reviewed all the materials pursuant to the City's <br /> Purchasing Policy and decided to deny the protest because:1)being late <br /> to a mandatary pm-bid tour is nota basis for rejecting the bid as non- <br /> responsive;2)prejudice was not identified;and 3)material advantage was <br /> not identified. Precision Earthworks has appealed to the Coy Council <br /> pursuant to the Purchasing Policy. They request that you uphold their <br /> protest and award them the contract.The City Council's choices are:1) <br /> deny the appeal and the award of the contract will go to Finishing Edge;or <br /> • <br /> • <br /> 200 <br />
