June 24,2009
Attomey Iles stated that the ultimate decision Is the Planning Directors.
He has heard that the direction is that staff should be very diligent in
reviewing this application and also evaluate whether the other issue raised
at the Port plays into whether the application is a valid application.
Council Member Stonecipher commented that she is uncomfodable taking
on this issue given that It Is connected to the residency issue. She voiced
that we should look to the ordinance that we operate under.
Council Member Olson withdrew his resolution and substituted the
following:
Moved by Council Member Olson, seconded by Council Member
Nielsen that the permit Is not issued by the Planning Director until
such time as the Planning Director reports back to the full council
with respect to his review of the pertinent comp plan amendments in
the city, the other actions and pot'cies of the city with respect to
issuance of these permits for historically protected buildings as the
s
Colli ie.So if the planning director is finished with his review by
next Wednesday,I would Invite him back next Wednesday or at such
time as he completes his work.
He fudher stated that the concern is that the demolition is very fast
tracked. There is no plan in place which would not allow this building to
stand pending fudher review.
Council Member Natloe stated that it has been made very clear that the
Planning Director has the authority for the ultimate decision. This is a
delay procedure out of our jurisdiction.
Counce Member Stonecipher commented that given the circumstance of a
one
week delay,a would not be an undue burden and would be advisable
for us to have Information about the demolition of the building and how It
relates to our Comprehensive Plan recognizing that this motion may not
stop that permit from being issued this Friday.
181
