STANDARD PROCUREMENT POLICY & FEDERAL EMERGENCY CONTRACTING <br /> 1.9.6 ARCHITECTURAL& ENGINEERING SERVICES AGREEMENTS <br /> Per City of Everett Municipal Code 2.04.030(2), <br /> "City Council shall approve all agreements for professional engineering or architectural services <br /> for the design of City improvements." <br /> This also applies to any agreement amendments. A "design of City improvement" is any <br /> engineering or architectural agreement that requires the service provider to provide stamped <br /> drawings. <br /> Architectural and Engineering Services are governed by Section 7.5. <br /> 1.9.7 PROFESSIONAL OR SPECIAL PERSONAL SERVICES AGREEMENTS <br /> Professional or Special Personal Services Agreements and Amendments that are not the result <br /> of a competitive solicitation and have an estimated or actual annual value greater than $50,000 <br /> must be awarded or approved by City Council.The limit may be lowered on a case by case basis <br /> at the Mayor's discretion or comprehensively by Mayoral Directive. See the definition for <br /> Special Personal Service in Section 2. <br /> Architectural and Engineering Services are governed by Section 7.5. <br /> 1.9.8 INDEMNIFICATION <br /> Any agreement or contract that contains an indemnification clause requiring the City to <br /> indemnify must be approved by City Council unless either (1) City Council has delegated that <br /> authority to the Mayor through previous action or(2)the City Attorney determines City Council <br /> approval is unnecessary. <br /> 1.9.9 CONTRACT AMENDMENTS AND CHANGE ORDERS <br /> Contract Amendments will ordinarily be approved in the same fashion as the initial contract. If, <br /> City Council awards the initial contract,then City Council must approve any contract <br /> amendments. If the Mayor has the authority to award and sign the contract, the Mayor will <br /> award and sign any related contract amendments. However, Change Orders for public works <br /> projects are governed by EMC 3.80.050. <br /> Page 6 of 57 <br />
