Section 28: "Submission of License - Employee Compen- sation insurance - Bond or Insurance Tor Liability": The applicant for a permit for a public display of fireworks shall at the time of application, submit his license for inspection and furnish proof that he carries compensation insurance for his employees as provided by the Laws of the State of Washington. He shall file with the Fire Marshal of the City of Everett a bond issued by an authorized surety company to be approved by such officer, conditioned upon the applicantTs payment of all damages to persons or property which shall or may result from or be caused by such public display of fireworks or any negligence on the part of the applicant or his or its agents, servants, employees or sub-contractors, in the presentation thereof, or a certificate of insurance evidencing the carrying of appropriate public liability insurance for the benefit of the person named therein as assured, as evidence of ability to respond in damages in at least such amount, said policies to be similarly approved. Section 29: "Public Display Permit Granted for Exclusive Purpose and is Non-transferable": If a permit for the public display of fireworks is granted, the sale, possession and use of fireworks for the public display is lawful for that purpose only. No such permit granted shall be transferable. Section 30: "Public Display Permit - Amount of Bond and Insurance": In the case of an application for a permit (or the public display of fireworks, the amount of such a surety bond shall be not less than 10,000.00, and the amount of such insurance shall be not less than 20,000.00. Section 31: "Permit For Retail Sale of Fireworks": No permit for the retail sale of fireworks shall be granted un- less the applicant shall comply with all of the provisions of this ordinance and have a valid license issued by the State Fire Marshal under Chapter 228, Laws of 1961 of the State of Washington, authorizing the holder thereof to engage in the retail sale of fireworks; further the applicant shall have a valid business license from and issued by the City of Everett; the applicant shall have a public liability and property damage insurance policy or certificate evidencing the existence of such policy in the amount of $10,000.00 for one person and $20,000.00 for injuries to two or more persons as the result of one accident, and $5,000.00 property damage; and the holder of such retail permit shall be authorized to sell fireworks only in those locations as shall be in conformance with the zoning code of the City of Everett, being Ordinance No. 3572, Everett City Code 15.04 et seq. • laUCECtxxlIMIRMIEmaft.IXXgxxi x ›i*MCIX)aMictcx&Co=aviti xxTbducboaxasx WA itx 1 XfsX K xxianclamoclummoceactoonexpezatittx rxxxxxxxxxxx xxx =Wax tkawaasotxxecalcatmackemoltxthec xoomix dx 32 Section : "Application for Permit": Any person who desires to engage in the retail sale of fireworks shall first make written, verified application to the Fire Marshal of the Everett Fire Department and accompany such application with the application fee as hereinafter provided in this ordinance, which application must be signed; if the application is made by a partnership, it shall be signed by each partner of the partnership and if the application is made by a corporation, it shall be signed by an officer of the corporation and bear the seal of said corporation. -5-
