Section 28: "Submission of License - Employee Compen- <br /> sation insurance - Bond or Insurance Tor Liability": The <br /> applicant for a permit for a public display of fireworks shall at <br /> the time of application, submit his license for inspection and <br /> furnish proof that he carries compensation insurance for his <br /> employees as provided by the Laws of the State of Washington. He <br /> shall file with the Fire Marshal of the City of Everett a bond <br /> issued by an authorized surety company to be approved by such <br /> officer, conditioned upon the applicantTs payment of all damages <br /> to persons or property which shall or may result from or be caused <br /> by such public display of fireworks or any negligence on the <br /> part of the applicant or his or its agents, servants, employees <br /> or sub-contractors, in the presentation thereof, or a certificate <br /> of insurance evidencing the carrying of appropriate public <br /> liability insurance for the benefit of the person named therein <br /> as assured, as evidence of ability to respond in damages in at <br /> least such amount, said policies to be similarly approved. <br /> Section 29: "Public Display Permit Granted for Exclusive <br /> Purpose and is Non-transferable": If a permit for the public <br /> display of fireworks is granted, the sale, possession and use of <br /> fireworks for the public display is lawful for that purpose only. <br /> No such permit granted shall be transferable. <br /> Section 30: "Public Display Permit - Amount of Bond <br /> and Insurance": In the case of an application for a permit (or <br /> the public display of fireworks, the amount of such a surety bond <br /> shall be not less than 10,000.00, and the amount of such insurance <br /> shall be not less than 20,000.00. <br /> Section 31: "Permit For Retail Sale of Fireworks": <br /> No permit for the retail sale of fireworks shall be granted un- <br /> less the applicant shall comply with all of the provisions of <br /> this ordinance and have a valid license issued by the State Fire <br /> Marshal under Chapter 228, Laws of 1961 of the State of Washington, <br /> authorizing the holder thereof to engage in the retail sale of <br /> fireworks; further the applicant shall have a valid business <br /> license from and issued by the City of Everett; the applicant <br /> shall have a public liability and property damage insurance policy <br /> or certificate evidencing the existence of such policy in the <br /> amount of $10,000.00 for one person and $20,000.00 for injuries <br /> to two or more persons as the result of one accident, and <br /> $5,000.00 property damage; and the holder of such retail permit <br /> shall be authorized to sell fireworks only in those locations as <br /> shall be in conformance with the zoning code of the City of Everett, <br /> being Ordinance No. 3572, Everett City Code 15.04 et seq. <br /> • <br /> laUCECtxxlIMIRMIEmaft.IXXgxxi x <br /> ›i*MCIX)aMictcx&Co=aviti xxTbducboaxasx <br /> WA itx 1 XfsX K xxianclamoclummoceactoonexpezatittx <br /> rxxxxxxxxxxx xxx <br /> =Wax tkawaasotxxecalcatmackemoltxthec <br /> xoomix dx <br /> 32 <br /> Section : "Application for Permit": Any person who <br /> desires to engage in the retail sale of fireworks shall first <br /> make written, verified application to the Fire Marshal of the <br /> Everett Fire Department and accompany such application with the <br /> application fee as hereinafter provided in this ordinance, which <br /> application must be signed; if the application is made by a <br /> partnership, it shall be signed by each partner of the partnership <br /> and if the application is made by a corporation, it shall be <br /> signed by an officer of the corporation and bear the seal of said <br /> corporation. <br /> -5- <br />
