9. City of Everett standard plans in effect as of the date Bids are opened; <br /> 10. Notice to Bidders/Instructions to Bidders; <br /> 11. Contractor's completed Bid Form; and <br /> 12. Certifications and affidavits as required by this Contract and by law. <br /> Any inconsistency in the parts of the Contract shall be resolved by following this order of <br /> precedence in the list above (e.g., 1 presiding over 2, 3, 4, 5, and 6; 2 presiding over 3, 4, <br /> 5, and 6; and so forth). This order of precedence shall not apply when Work is required by <br /> one part of the Contract but omitted from another part or parts of the Contract. The Work <br /> required in one part must be furnished even if not mentioned in other parts of the Contract <br /> 1.3 General <br /> A. These parts complement each other in describing the complete Work. Any requirement in <br /> one part binds as if stated in all parts. The Contractor shall provide any work or materials <br /> clearly implied in the Contract even if the Contract does not mention it specifically. Any <br /> inconsistency in the parts of the Contract shall be referred to the Owner's Representative <br /> attention fora determination of the intended requirements. <br /> B. The Work required in one part must be furnished even if not mentioned in other parts of <br /> the Contract. If any part of the Contract requires Work that does not include a description <br /> for how the Work is to be performed, the Work shall be performed in accordance with <br /> standard trade practice(s). For purposes of the Contract, a standard trade practice is one <br /> having such regularity of observance in the trade as to justify an expectation that the <br /> Contractor will follow or observe the practice in performing the Work. In case of any <br /> ambiguity, disagreement or Dispute over interpreting the Contract, the Owner's <br /> Representative's decision will be final as provided in these General Conditions. <br /> C. Approved Shop Drawings, other Contractor's Submittals, and the reports and drawings of <br /> subsurface and physical conditions are not Contract Documents. <br /> ARTICLE 2 SPECIFICATIONS AND DRAWINGS <br /> 2.1 Interpretation of Specifications and Drawings <br /> A. The Specifications and Drawings are intended to be explanatory and supportive of each <br /> other. Work specified on the Drawings and not in the Specifications, or vice versa, shall be <br /> executed as if specified in both. In the event the Work to be done or matters relative <br /> thereto are not sufficiently detailed or explained in the Contract Documents, the <br /> Contractor shall immediately ask the Owner's Representative for further explanation and <br /> shall comply with such explanation. In the event of doubt or question arising respecting <br /> the true meaning of the Specifications or Drawings, Contractor shall refer to the Owner's <br /> Representative for his or her decision. <br /> B. The Specifications may vary in form, format and style. Some specification sections are <br /> written in varying degrees of streamlined or declarative style and some sections may be <br /> relatively narrative by comparison.
