Relationship to Construction General Conditions Fee <br /> The Construction General Conditions Fee identified in Section 7.3 of the Progressive Design- <br /> Build Contract shall be the sole reimbursement for all costs and expenses associated with the <br /> Construction General Conditions Work regardless of whether such work is provided directly by <br /> Design-Builder or General Contractor(if not the Design-Builder, or indirectly via subcontract or <br /> vendor agreement. <br /> Cost of the Phase 2 Work as identified in Section 7.5 of the Progressive Design-Build Contract <br /> shall not include any Construction General Conditions Work identified in this Exhibit D. <br /> Section 2. Construction General Conditions Work <br /> Design-Builder shall be responsible for all required Construction General Conditions Work, in <br /> connection with the Phase 2 Services, as well as the performance of the related obligations, as <br /> described below. <br /> • Supervisory and Administrative Personnel (also includes General Contractor if <br /> Design-Builder is not the General Contractor) <br /> — All Design-Builder's supervisory and administrative personnel engaged in the on-site <br /> performance of Phase 2 Services, including but not limited to the Design-Build <br /> Project Manager, Construction Manager, Construction Superintendent(s), and those <br /> responsible for managing and implementing Design-Builder's scheduling, cost <br /> control, billing, health and safety, QA/QC, and expenses. For clarity, only the <br /> Design-Builder's craft labor shall be excluded from this category; any other <br /> on-site personnel provided by the Design-Builder (or General Contractor if <br /> Design-Builder is not acting as the General Contractor) shall be included as <br /> General Conditions and covered by the Design-Builder's General Conditions <br /> Fee. <br /> — Time of Design-Builder's supervisory and administrative personnel engaged off of <br /> the Project Site to support the Phase 2 Services, including visits to suppliers and <br /> manufacturing locations, attendance at workshops, travel, and other activities <br /> required for the coordination, of production or transportation of material or equipment <br /> necessary for the Phase 2 Services, but only for that portion of their time required for <br /> the Phase 2 Services. <br /> — Time of the Design-Builder's personnel stationed at the Design-Builder's principal or <br /> branch offices and performing Phase 2 Services. For clarity, this does not include <br /> time of the Engineer of Record associated with providing submittal reviews, <br /> responding to RFIs, and other activities necessary to ensure the construction <br /> complies with the design intent. <br /> Page 1 of 4 <br />
