adopted by EMC 16.005.010. The amended citation included violations of the International <br /> Residential Code. Copies of the violation citation were mailed via first class and certified <br /> mail to the Respondent's last known address,which Officer Golden obtained from <br /> Snohomish County Assessor's record. Notice was provided to Stephanie Quiroga, <br /> registered agent for Broadway Station Apartments LLC. A copy was posted on the subject <br /> property. (Exhibit#16,Amended Violation Citation, dated January 9, 2018 with mail <br /> receipts) (Exhibit#17, Declaration of Service, dated January 9, 2018 with photos) <br /> (Testimony of Code Enforcement Officer Golden) <br /> 12. On January 12,2018, Stephanie Quiroga requested that the hearing be rescheduled from <br /> February 15,2018. A notice of rescheduled hearing was sent via first class and certified <br /> mail to the Respondent and Stephanie Quiroga setting this matter before the Hearing <br /> Examiner on March 15, 2018. On January 23,2018,Ms. Quiroga informed the Code unit that she had retained an architect <br /> to continue the construction work on the subject property. On March 7,2018, Officer Golden reinspected the subject property and observed and <br /> photographed that the residential structure appeared to be vacant,the western wall of the <br /> structure was exposed to the weather,the structure remained boarded and secure from <br /> trespass,and the electrical box located on an exterior wall near the alley had exposed <br /> electrical wiring. (Exhibit#1 a-1 d, Inspection Photos, dated March 7, 2018) (Testimony of <br /> Code Enforcement Officer Golden) <br /> 15. The City provided the Respondent with an opportunity to correct the conditions that were in <br /> violation of sections of the EMC and provided notice of the date,time and place of this <br /> hearing. Jorge and Stephanie Quiroga, owner of the Respondent appeared at the hearing. <br /> 16. Chief Inspector de Budden testified at the hearing that the use of the International <br /> Residential Code (IRC)does not apply to this matter because the structure has three floors <br /> which makes it a commercial structure and violations would fall under the International <br /> Building Code(IBC). The language between the IRC and IBC codes is identical. All <br /> parties present agreed to accept the scrivener error in the proposed Order. Chief Inspector <br /> de Budden further stated that construction activity occurring on the structure was not <br /> permitted and because of the deteriorated condition of the structure and the compromised <br /> condition of the electrical system,the structure was deemed unsafe for occupancy. He <br /> stated that no applications have been submitted for the compromised electrical system or <br /> other conditions present on the structure. Jorge Quiroga, owner of the structure,testified at the hearing that when they purchased the <br /> subject property in October 2017 it was their intention to rehabilitate the structure.
