CITY OF EVERETT SPECIAL PROVISIONS <br /> Interim Completion Date: ***The day the Engineer determines that the Contractor has <br /> achieved interim completion. Interim completion means that pipeline construction is complete, <br /> the facilities have been tested, accepted and the trench backfilled and compacted, the City <br /> has full and unrestricted use and benefit of the facilities, both from the operational and safety <br /> standpoint, and there is no longer a need for construction activities within the Port of Everett <br /> (POE) property. Stockpile removal, cleanup, and restoration or other construction Work on <br /> City of Everett's PGSF property may or may not be complete.*** <br /> Substantial Completion Date: The day the Engineer determines that the conditions listed <br /> under Interim Completion Date have been met, in addition to the following: The stockpiles <br /> have been removed and City property restored to the satisfaction of the Engineer, and only <br /> minor incidental work, replacement of temporary substitute facilities, plant establishment <br /> periods, or correction or repair remains for the Physical Completion of the total Contract. <br /> Physical Completion Date: The day all of the Work is physically completed on the project. <br /> All documentation required by the Contract and required by law does not necessarily need to <br /> be furnished by the Contractor by this date. <br /> Completion Date: Date on which Project is ready for Final Acceptance. All physical work, <br /> including Punch List, is complete and Contractor has completed and fulfilled all contractual <br /> obligations except any maintenance of landscaping. Contractual obligations that must be <br /> fulfilled prior to achievement of the Completion Date include and are not limited to; the <br /> Contractor's furnishing all documentation, including correct, complete and accurate as-built or <br /> record drawings and operation and maintenance manuals and transfer of warranties. (This <br /> definition replaces the definition in WSDOT 1-01.3 for Completion Dates.) <br /> Revise the following definitions to read as follows: <br /> Award: The decision by Everett City Council to award a contract and authorize the Mayor to sign <br /> ■ the Contract. No contract is formed until the Mayor signs the contract. (This definition replaces <br /> the definition in WSDOT 1-01.3 for Bid Documents.) <br /> Bid Documents: The component parts of the proposed Contract which may include, but are not <br /> limited to, the Proposal Form, the proposed Contract Provisions, the proposed Contract Plans, and <br /> Addenda. (This definition replaces the definition in WSDOT 1-01.3 for Bid Documents.) <br /> Contract: Written agreement signed between the City and Contractor and includes Division C — <br /> CONTRACT, Division P - PROPOSAL, Division B — BID ITEM DESCRIPTIONS, Special <br /> Provisions, Contract Plans, Standard Specifications and amendments, Standard Plans in effect as <br /> of the date Bids are opened, Addenda, supplemental agreements, change orders, certifications <br /> and affidavits required by this Contract and by law, and Federal requirements that apply to this <br /> Contract and Project. (This definition replaces the definition in WSDOT 1-01.3 for Contract.) <br /> Contract Bond(s): Include a separate performance bond and payment bond, as set forth in the <br /> Contract Documents. (This definition supplements the definition in WSDOT 1-01.3 for Contract <br /> Bond.) <br /> Engineer: The City's representative who administers the construction program for the City. <br /> Provisions in the Contract Documents that state the Engineer "shall" or "will" shall be deemed to <br /> mean that the Engineer shall or will take such action if requested in writing by the Contractor. (This <br /> definition replaces the definition in WSDOT 1-01.3 for Engineer.) <br /> Specifications: Includes 2021 WSDOT/APWA Standard Specifications and latest Amendments, <br /> and all other specifications (including these Special Provisions) for the prescribed Work in this <br /> Contract. (This definition replaces the definition in WSDOT 1-01.3 for Specifications.) <br /> Working Drawings: Drawings, shop drawings, plans, diagrams, or calculations, including a <br /> schedule of submittal dates for Working Drawings where specified, which the Contractor must <br /> POE Combined Sewer Main Imp.
