(This definition replaces the definition in WSDOT 1-01.3 for Working <br /> Drawings.) <br /> Supplement Section 1-01.3 by adding the following: I <br /> All references in the Standard Specifications to the terms "State", "Department of Transportation", <br /> "Washington State Transportation Commission", "Commission", "Secretary of Transportation", <br /> "Secretary", "Headquarters", and "State Treasurer" shall be revised to read "City." <br /> All references to the terms "State" or "state" shall be revised to read "City" unless the reference is <br /> to an administrative agency of the State of Washington, a State statute or regulation, or the context <br /> reasonably indicates otherwise. <br /> All references to "State Materials Laboratory" shall be revised to read "City designated location." <br /> All references to "final contract voucher certification" shall be interpreted to mean the City form(s) <br /> by which final payment is authorized, and final completion and acceptance granted. <br /> Additive: A supplemental unit of work or group of bid items, identified separately in the Proposal, <br /> that may, at the discretion of the City, be awarded in addition to the base Bid. <br /> Alternative or Alternate: One of two or more units of Work or groups of bid items, identified <br /> separately in the Proposal, from which the City may make a choice between different methods or <br /> material of construction for performing the same Work. <br /> Award Date: The date of the formal action by the Everett City Council to accept the lowest 1 <br /> responsible and responsive Bidder for the Work. <br /> Baseline COVID-19 Requirements: Baseline COVID-19 Requirements include all COVID-19 <br /> Requirements applicable to the Work as of the date of Bid opening. <br /> Bid Opening Date: The date the Everett City Clerk publicly opens and reads the Bids. <br /> Business Day: A business day is any day from Monday through Friday except holidays as listed <br /> in 1-08.5. <br /> Change Order: Reference to Change Order shall include all rights of the City and Contractor <br /> under 1-04.4 CHANGES. Agreed Change Orders shall be in the form attached as Appendix C. <br /> Unilateral Change Orders shall be in the form attached as Appendix C. <br /> City: The City of Everett, Washington. "City" and "Owner" and "Contracting Agency" mean the <br /> same. I <br /> City-Port Agreement: The Temporary Construction License Agreement between the City of <br /> Everett and Port of Everett, which is provided in Appendix D. <br /> City's Representative: The person designated in writing by the City to act as its representative <br /> at the construction site and to perform construction inspection service and administrative functions <br /> relating to this Contract. The terms "Engineer", "Architect", or "Owner's Representative" shall be <br /> interchangeable with City's Representative. <br /> Contract Claim: Any request by the Contractor for additional time or money resulting in <br /> adjustment of Contract Sum or Contract Time irrespective of the cause or reason for the request. <br /> Contract Claims include, but are not limited to, requests by the Contractor for additional time or111 <br /> money due to Extra Work, inefficiencies, Delays, interferences, and problems with the design. <br /> Contract Claim includes, but is not limited to, claims or requests by Subcontractors for extensions <br /> of Contract Time, adjustment of Contract Sum, additional compensation that the Contractor <br /> attempts to pass through or assert against the City, or claims against the City arising out of a third <br /> party's claim against the Contractor. <br /> Contract Documents: All of the items that together make up the complete Contract.
