CITY OF EVERETT SPECIAL PROVISIONS <br /> to remove someone from the job site does not relieve the Contractor from its obligation <br /> to remove someone. <br /> 1-05.18(3)H Safety Standards <br /> The Contractor shall comply with Section 107 of the Contract Work Hours and Safety <br /> Standards Act (40 U.S.C. 327-330) as supplemented by Department of Labor <br /> Regulations (29 CFR, Part 5). Under this Section, the Contractor shall not require any <br /> laborer or mechanic to work in surroundings or under working conditions that are <br /> unsanitary, hazardous, or dangerous to its health and safety as determined under <br /> construction, safety, and health standards promulgated by the Secretary of Labor. These <br /> requirements do not apply to the purchase of supplies or materials or articles ordinarily <br /> available on the open market, or contracts for transportation or transmission of <br /> intelligence. <br /> 1-05.18(3)1 Public Safety and Convenience <br /> The Contractor shall conduct its work so as to ensure the least possible obstruction to <br /> traffic and inconvenience to the general public, business, organizations and residents in <br /> the vicinity of the Work and to reasonably protect persons and property. No roads or <br /> street shall be closed to the public except with the permission of the City's Representative <br /> ' and the proper governmental authority. Fire hydrants on or adjacent to the Work shall be <br /> accessible to firefighting equipment. Temporary provisions shall be made by the <br /> Contractor for the use of sidewalks, private and public driveways and proper functioning <br /> ' of gutters, sewer inlets, drainage ditches and culverts, irrigation ditches and natural water <br /> courses. <br /> 1-05.19 City-Contractor Coordination <br /> (******) <br /> 1-05.19(1) Suggestions to Contractor <br /> Nothing in these Contract Documents requires the City's Representative to provide the <br /> Contractor with direction or advice on how to do the Work, construction practices, or means <br /> and methods. If the City's Representative approves, suggests or recommends any <br /> construction practice, means, method or manner for doing the Work or producing materials, <br /> the approval or recommendation shall not: (A) guarantee that following the method or manner <br /> will result in compliance with the Contract Documents; (B) relieve the Contractor of any risks <br /> or obligations under the Contract Documents; or (C) create liability by the City to the <br /> Contractor. <br /> Suggestions as to the plans or methods of accomplishing the Work or Contract requirements <br /> by the City or the City's Representative to the Contractor but not specified or required, if <br /> adopted or followed by the Contractor in whole or in part, shall be used at the risk and <br /> responsibility of the Contractor. The City and the City's Representative assume no <br /> ' responsibility therefore and in no way will be held liable for any defects in the Work which may <br /> result from or be caused by use of such plan or method of Work. <br /> 1-05.19(2) Meetings with City <br /> The Contractor shall have its duly authorized representative attend periodic informational <br /> meetings with the City's Representative and City staff, as reasonably required by the City. <br /> Contractor, City, and City's Representative shall meet as often as determined by the City's <br /> Representative, but no less often than once each month. The purpose of the meeting is to <br /> review Project status in relation to the construction schedule; review value of Work completed <br /> during the previous month; and, if applicable, review Contractor's plans to return Project status <br /> 111 to that required by the schedule.
