November 23,2021 1
Revise the third paragraph under GENERAL DESCRIPTION AND LOCATION OF THE 1
PROJECT to read as follows:
The Contractor must be thoroughly familiar with and comply at all times with the I
City-Port Agreement. For example, the City-Port Agreement allows the Work on the
Port of Everett property only in a defined License Area, and the City-Port Agreement
expires on the City-Port Agreement Expiration Date (as defined in Section 1-01.3).
The Contractor must complete all Work on Port of Everett property and achieve
physical completion (as defined in Section 1-01.3) no later than the City-Port
Agreement Expiration Date. Failure to achieve physical completion by that date may
trigger Contractor payments to the City as described in Section 1-08.9(1).
Under Section 1-01.3 Definitions: I
Revise the definitions listed below to read as follows:
City-Port Agreement Expiration Date: The term of the City-Port Agreement expires one U
hundred fifty (150) calendar days after the effective date of the Notice to Proceed issued to
Contractor by the City or June 30, 2022, whichever comes first.
Interim Completion Date: Date on which substantial completion is achieved.
Substantial Completion Date: The day the Engineer determines that the Contractor has
achieved substantial completion. Substantial completion means that pipeline construction
is complete with all improvements completely installed; the facilities have been tested,
accepted and the trench backfilled and compacted with appropriate soils, the City has full
and unrestricted use and benefit of the facilities, both from the operational and safety
standpoint, and there is no longer a need for construction activities within the Port of
Everett (POE) property, with the Port of Everett having the ability to utilize the entire
License Area. In addition, the stockpiles on City property have been removed and the
property restored to the satisfaction of the Engineer, and only minor incidental work,
replacement of temporary substitute facilities, plant establishment periods, or correction or111
repair remains for the Physical Completion of the total Contract.
Physical Completion Date: The day all of the Work is physically completed on the
project. All physical work, including Punch List, is complete and Contractor has completed
and fulfilled all contractual obligations except any maintenance of landscaping. All
documentation required by the Contract and required by law does not necessarily need to
be furnished by the Contractor by this date.
Completion Date: Date on which Project is ready for Final Acceptance. Contractual
obligations that must be fulfilled prior to achievement of the Completion Date include and
are not limited to; the Contractor's furnishing all documentation, including correct, complete
and accurate as built or record drawings and operation and maintenance manuals and
transfer of warranties. This definition replaces the definition in WSDOT 1-01.3 for
Completion Dates.
1
POE Combined Sewer Main Imp. Addendum No. 1
Work Order#UP3768 Page 2 of 12
1
