November 23,2021 1 <br /> Revise the third paragraph under GENERAL DESCRIPTION AND LOCATION OF THE 1 <br /> PROJECT to read as follows: <br /> The Contractor must be thoroughly familiar with and comply at all times with the I <br /> City-Port Agreement. For example, the City-Port Agreement allows the Work on the <br /> Port of Everett property only in a defined License Area, and the City-Port Agreement <br /> expires on the City-Port Agreement Expiration Date (as defined in Section 1-01.3). <br /> The Contractor must complete all Work on Port of Everett property and achieve <br /> physical completion (as defined in Section 1-01.3) no later than the City-Port <br /> Agreement Expiration Date. Failure to achieve physical completion by that date may <br /> trigger Contractor payments to the City as described in Section 1-08.9(1). <br /> Under Section 1-01.3 Definitions: I <br /> Revise the definitions listed below to read as follows: <br /> City-Port Agreement Expiration Date: The term of the City-Port Agreement expires one U <br /> hundred fifty (150) calendar days after the effective date of the Notice to Proceed issued to <br /> Contractor by the City or June 30, 2022, whichever comes first. <br /> Interim Completion Date: Date on which substantial completion is achieved. <br /> Substantial Completion Date: The day the Engineer determines that the Contractor has <br /> achieved substantial completion. Substantial completion means that pipeline construction <br /> is complete with all improvements completely installed; the facilities have been tested, <br /> accepted and the trench backfilled and compacted with appropriate soils, the City has full <br /> and unrestricted use and benefit of the facilities, both from the operational and safety <br /> standpoint, and there is no longer a need for construction activities within the Port of <br /> Everett (POE) property, with the Port of Everett having the ability to utilize the entire <br /> License Area. In addition, the stockpiles on City property have been removed and the <br /> property restored to the satisfaction of the Engineer, and only minor incidental work, <br /> replacement of temporary substitute facilities, plant establishment periods, or correction or111 <br /> repair remains for the Physical Completion of the total Contract. <br /> Physical Completion Date: The day all of the Work is physically completed on the <br /> project. All physical work, including Punch List, is complete and Contractor has completed <br /> and fulfilled all contractual obligations except any maintenance of landscaping. All <br /> documentation required by the Contract and required by law does not necessarily need to <br /> be furnished by the Contractor by this date. <br /> Completion Date: Date on which Project is ready for Final Acceptance. Contractual <br /> obligations that must be fulfilled prior to achievement of the Completion Date include and <br /> are not limited to; the Contractor's furnishing all documentation, including correct, complete <br /> and accurate as built or record drawings and operation and maintenance manuals and <br /> transfer of warranties.
