November 23,2021 1 <br /> In addition to any other requirements in the Contract Documents, the Contractor shall I <br /> execute the Work in accordance with the conditions, restrictions and requirements for the <br /> Work contained in the City-Port Agreement, including without limitation: <br /> (1) The Contractor's use of the Port of Everett property is limited to the License Area, as <br /> defined and depicted by Exhibit C to the City-Port Agreement. <br /> (2) The City-Port Agreement expires on the City-Port Agreement Expiration Date. The <br /> Contractor must achieve physical completion no later than the City-Port Agreement <br /> Expiration Date. I <br /> (3) The Contractor must comply with the requirements contained in Exhibit D <br /> (Stormwater Management Requirements) and Exhibit E (Construction Requirements) <br /> of the City-Port Agreement. <br /> The Contractor shall execute the Work in a manner so that the Work does not breach or <br /> otherwise cause non-compliance with any provision of the City-Port Agreement. If there is <br /> a conflict between a Contract Document and the conditions, restrictions and requirements <br /> for the Work in the City-Port Agreement, the Contractor shall provide written notice thereof <br /> to the City, and the City-Port Agreement shall govern unless the City determines otherwise <br /> in writing. <br /> In addition to the License Area, the Contractor may use certain portions of the Port of <br /> Everett property for access to the License Area. This access is described in Exhibit E <br /> (Construction Requirements) to the City-Port Agreement. <br /> Contractor should also refer to 1-05.14 Cooperation with Other Contractors. 1 <br /> The Contractor must include compliance with the City-Port Agreement as part of its Bid. <br /> For example, the following is a non-exhaustive table of requirements from Exhibit D and <br /> Exhibit E of the City-Port Agreement that Contractor is obligated to perform or comply with <br /> under this Contract. <br /> City-Port Agreement Summary of Contractor Obligation <br /> (These are only summaries and not complete descriptions. The text of the City- <br /> Port Agreement always governs over these summaries.) <br /> Exhibit D, Paragraph B Contractor must comply with CSGP and AO. <br /> Exhibit D, Paragraph C Contractor must prepare SWPPP as described in Paragraph C. <br /> Exhibit D, Paragraph D Contractor must discharge stormwater and maintain dewatering treatment as <br /> described. Contractor's work must not result in a discharge of construction stormwater <br /> or dewatering water from the License Area to a surface water. <br /> Exhibit D, Paragraph E Contractor will cooperate with City to identify a CSGP monitoring point before <br /> earthwork begins and to provide information as described in Paragraph E. <br /> Exhibit D, Paragraph F Contractor will notify the City and Port immediately if a surface water discharge <br /> occurs. Contractor acknowledges this could result in a stop work order as described <br /> in Paragraph F. <br /> Exhibit D, Paragraph G Contractor will comply with all reasonable and appropriate instructions issued by the <br /> CSGP Professional to ensure compliance with the terms of the CSGP and AO. <br /> Exhibit E, Paragraph 1 Contractor will start the Work and progress with the Work as described in Paragraph <br /> 1. <br /> Exhibit E, Paragraph 2 Contractor will provide security as described in Paragraph 2. <br /> POE Combined Sewer Main Imp.
