November 23,2021 <br /> Exhibit E, Paragraph 3 Contractor shall meet the release requirements described. Contractor will undertake <br /> the Work so that portions of the License Area may be released as soon as practicable. <br /> Contractor understands that once a portion of the License Area is released,the <br /> Contractor has no further right to use the released portion. Contractor's storage of <br /> materials within a portion of the License Area shall not be the cause of a delay in <br /> releasing a portion of the License Area. Contractor shall place high visibility fencing at <br /> termination of each released area. <br /> Exhibit E, Paragraph 4 Contractor shall meet the schedule and release requirements described. Contractor <br /> shall complete the work described in Paragraph 4(d). If the Port requires access to <br /> the cargo storage pad as described in Paragraph 4(e), Contractor will accommodate <br /> 1 that requirement and fully cooperate in providing the required access. Contractor shall <br /> not store materials in any way that blocks access to the cargo storage pad and the use <br /> of the southern access point to the Port Property <br /> Exhibit E, Paragraph 5 Contractor must take fully into account and accommodate the Crossings as described <br /> in Paragraph 5. Contractor will not receive any adjustment of the Contract Sum <br /> arising from the impact of Crossings on the Work. Contractor will mark Crossings with <br /> visible stakes and will control traffic using a four-way stop intersection to reduce traffic <br /> conflicts. <br /> Exhibit E, Paragraph 6 Contractor shall use the access roads as described in Paragraph 6. If directed by the <br /> City, Contractor will (1)build the described 50-foot-wide gravel access road at the <br /> location shown on Exhibit C and (2)remove the access road material. This work is <br /> part of the bid; Contractor will not receive any adjustment of the Contract Sum arising <br /> M from this work. <br /> Exhibit E, Paragraphs 7, 9 Contractor must confine the Work to the unreleased portions of the License Area. <br /> Contractor must comply with Crossing requirements. Contractor must take this fully <br /> into account in its bid. Contractor will not receive any adjustment of the Contract Sum <br /> arising from the impact of Crossings on the Work. <br /> Exhibit E, Paragraph 8 Contractor may use unreleased License Area for staging and laydown of materials, <br /> except for in the location of the Crossings. <br /> Exhibit E, Paragraph 11 Contractor must diligently coordinate with the Port's contractor to avoid construction <br /> conflicts. Contractor shall meet with the City,the Port,and the Port's contractor once <br /> per week during the weeks prior to the commencement of the Work, and throughout <br /> the duration of the Work.The Contractor will provide a detailed schedule and timeline <br /> for the Work that the City may provide the Port. <br /> Exhibit E, Paragraph 12 Contractor shall protect all utilities the Contractor encounters within the License Area. <br /> If any of these utilities is damaged,the Contractor will replace in like condition,to the <br /> reasonable satisfaction of the Port. The Contractor must immediately notify and <br /> coordinate with the City and the Port upon encountering any active or potentially active <br /> utilities, and the City and the Port shall mutually agree on the schedule and scope for <br /> protecting, replacing, or abandoning such utilities,and the Contractor shall execute <br /> shall scope and schedule. For utilities to be protected or replaced,the Contractor <br /> shall provide inspection services, including land surveys, CCTV,or other methods, as <br /> approved by the Port,to demonstrate that the utilities are returned in good condition. <br /> Exhibit E, Paragraph 13 Contractor will comply with backfill material specifications as described in Paragraph <br /> 13. <br /> Exhibit E, Paragraph 14 Contractor will comply final elevation requirements as described in Paragraph 14. <br /> Exhibit E, Paragraph 15 Contractor will comply with requirements regarding stockpiles as described in <br /> Paragraph 15. Contractor will coordinate with City's environmental professional as <br /> described in such paragraph. Contractor will not return soil to the License Area that <br /> does not meet the requirements specified in the Port SGWMP. <br /> Exhibit E, Paragraph 16 Contractor will execute the work regarding dewatering and stormwater equipment and <br /> pipelines as described in Paragraph 16. <br /> Exhibit E, Paragraph 19 All haul road material imported by the Contractor must be removed from the Port <br /> Property prior to the City-Port Agreement Expiration Date. <br /> Exhibit E, Paragraph 20 Contractor shall comply with Washington State's Ambient Air Quality Standards as <br /> described in Paragraph 20. <br /> Under Section 1-05.11 Final Inspections and Operational Testing: <br /> POE Combined Sewer Main Imp.
