November 23,2021 1 Replace Section 1-05.11(1) Interim Completion Date/Substantial Completion Date with the I following: 1-05.11(1) Substantial Completion Date I All Work on Port of Everett property must be substantially complete as defined in Section 1- 01.3. The Contractor is required to schedule and complete all punch list and repairs on Port of Everett property prior to such date. When the Contractor considers the Work to be substantially complete, the Contractor shall so notify the Engineer and request the Engineer establish the Substantial Completion Date. The Contractor's request shall list the specific items of Work that remain to be completed in order to reach physical completion. The Engineer will schedule an inspection of the Work with the Contractor to determine the status of completion. The Engineer may also establish the Substantial Completion Date unilaterally. If, after this inspection, the Engineer concurs with the Contractor that the Work is substantially complete and ready for its intended use, the Engineer, by written notice to the Contractor, will set the Substantial Completion Date. If, after this inspection the Engineer does not consider the Work substantially complete and ready for its intended use, the Engineer will, by written notice, so notify the Contractor giving the reasons therefor. Upon receipt of written notice concurring in or denying substantial completion, whichever is applicable, the Contractor shall pursue vigorously, diligently and without unauthorized interruption, the Work necessary to reach Substantial and Physical Completion. The Contractor shall provide the Engineer with a revised schedule indicating when the Contractor expects to reach substantial and physical completion of the Work. The above process shall be repeated until the Engineer establishes the Substantial Completion Date and the Contractor considers the Work physically complete and ready for final inspection. Revise the first sentence under Section 1-05.11(2) Final Inspection and Physical Completion I Date to read as follows: When the Contractor considers the Work physically complete, as defined in Section 1-01.3, 1 and ready for final inspection, the Contractor, by written Notice, shall request the Engineer to schedule a final inspection. Revise the Section 1-07.18(2) Additional Insured to read as follows: All insurance policies, with the exception of Professional Liability and Workers Compensation, shall name the following listed entities as additional insured(s): • The City and its officers, elected officials, employees, agents, and volunteers • The Port of Everett and its officers, elected officials, employees, agents, and volunteers. I The above-listed entities shall be additional insured(s) for the full available limits of liability maintained by the Contractor, whether primary, excess, contingent or otherwise, irrespective I of whether such limits maintained by the Contractor are greater than those required by this Contract, and irrespective of whether the Certificate of Insurance provided by the Contractor POE Combined Sewer Main Imp.
