November 23,2021 1 <br /> Replace Section 1-05.11(1) Interim Completion Date/Substantial Completion Date with the I <br /> following: <br /> 1-05.11(1) Substantial Completion Date I <br /> All Work on Port of Everett property must be substantially complete as defined in Section 1- <br /> 01.3. The Contractor is required to schedule and complete all punch list and repairs on <br /> Port of Everett property prior to such date. <br /> When the Contractor considers the Work to be substantially complete, the Contractor shall <br /> so notify the Engineer and request the Engineer establish the Substantial Completion Date. <br /> The Contractor's request shall list the specific items of Work that remain to be completed in <br /> order to reach physical completion. The Engineer will schedule an inspection of the Work <br /> with the Contractor to determine the status of completion. The Engineer may also establish <br /> the Substantial Completion Date unilaterally. <br /> If, after this inspection, the Engineer concurs with the Contractor that the Work is <br /> substantially complete and ready for its intended use, the Engineer, by written notice to the <br /> Contractor, will set the Substantial Completion Date. If, after this inspection the Engineer <br /> does not consider the Work substantially complete and ready for its intended use, the <br /> Engineer will, by written notice, so notify the Contractor giving the reasons therefor. <br /> Upon receipt of written notice concurring in or denying substantial completion, whichever is <br /> applicable, the Contractor shall pursue vigorously, diligently and without unauthorized <br /> interruption, the Work necessary to reach Substantial and Physical Completion. The <br /> Contractor shall provide the Engineer with a revised schedule indicating when the <br /> Contractor expects to reach substantial and physical completion of the Work. <br /> The above process shall be repeated until the Engineer establishes the Substantial <br /> Completion Date and the Contractor considers the Work physically complete and ready for <br /> final inspection. <br /> Revise the first sentence under Section 1-05.11(2) Final Inspection and Physical Completion I <br /> Date to read as follows: <br /> When the Contractor considers the Work physically complete, as defined in Section 1-01.3, 1 <br /> and ready for final inspection, the Contractor, by written Notice, shall request the Engineer <br /> to schedule a final inspection. <br /> Revise the Section 1-07.18(2) Additional Insured to read as follows: <br /> All insurance policies, with the exception of Professional Liability and Workers <br /> Compensation, shall name the following listed entities as additional insured(s): <br /> • The City and its officers, elected officials, employees, agents, and volunteers <br /> • The Port of Everett and its officers, elected officials, employees, agents, and volunteers. I <br /> The above-listed entities shall be additional insured(s) for the full available limits of liability <br /> maintained by the Contractor, whether primary, excess, contingent or otherwise, irrespective I <br /> of whether such limits maintained by the Contractor are greater than those required by this <br /> Contract, and irrespective of whether the Certificate of Insurance provided by the Contractor <br /> POE Combined Sewer Main Imp.
