For example, the City-Port Agreement allows the Work on the <br /> Port of Everett property only in a defined License Area, and the City-Port Agreement <br /> expires on the City-Port Agreement Expiration Date (as defined in Section 1-01.3). <br /> The Contractor must achieve substantial completion no later than 120 calendar days <br /> • <br /> after the effective date of the Notice to Proceed. The Contractor must complete all <br /> Work on Port of Everett property and achieve physical completion (as defined in <br /> Section 1-01.3) of all work no later than the City-Port Agreement Expiration Date. <br /> Failure to achieve substantial completion or physical completion by those dates may <br /> trigger liquidated damages as described in Section 1-08.9. <br /> Under Section 1-01.3 Definitions: <br /> Revise the definitions listed below to read as follows: <br /> City-Port Agreement Expiration Date: The earliest of the following: <br /> (a) one hundred fifty (150) calendar days after the effective date of the Notice to Proceed <br /> issued to Contractor by the City; <br /> (b) June 30, 2022; or I <br /> (c) thirty (30) days following the Interim Completion Date. <br /> Interim Completion Date: The day the Engineer determines that the Contractor has I <br /> achieved interim completion.
