The parties agree the City will suffer damage and be put to 1 additional expense in the event that the Contractor does not complete the work in all respects and have it ready for use by the completion date stated. Because it is difficult to accurately compute the amount of such costs and damages, the Contractor hereby covenants and agrees to pay to the City liquidated damages as computed in Section 1-08.9 of the Standard Specifications, as may be amended by the Special Provisions;fer-eaeh--ar d The remainder of Division C—Contract is as provided in Addendum#1. 1 SPECIAL PROVISION SPECIFICATIONS Revisions to the Special Provision Specifications are as follows: I DIVISION 1 —GENERAL REQUIREMENTS: Revise the third paragraph under GENERAL DESCRIPTION AND LOCATION OF THE I PROJECT to read as follows: The Contractor must be thoroughly familiar with and comply at all times with the City-Port Agreement. For example, the City-Port Agreement allows the Work on the Port of Everett property only in a defined License Area, and the City-Port Agreement expires on the City-Port Agreement Expiration Date (as defined in Section 1-01.3). The Contractor must achieve substantial completion no later than 120 calendar days • after the effective date of the Notice to Proceed. The Contractor must complete all Work on Port of Everett property and achieve physical completion (as defined in Section 1-01.3) of all work no later than the City-Port Agreement Expiration Date. Failure to achieve substantial completion or physical completion by those dates may trigger liquidated damages as described in Section 1-08.9. Under Section 1-01.3 Definitions: Revise the definitions listed below to read as follows: City-Port Agreement Expiration Date: The earliest of the following: (a) one hundred fifty (150) calendar days after the effective date of the Notice to Proceed issued to Contractor by the City; (b) June 30, 2022; or I (c) thirty (30) days following the Interim Completion Date. Interim Completion Date: The day the Engineer determines that the Contractor has I achieved interim completion. Interim completion is achieved when all improvements on Port of Everett property have been installed, the trench has been backfilled and compacted with the appropriate soils, and the Port of Everett has the ability to utilize the entire License Area. Revise the definition listed below to read as follows, deleting strike-out text: I Substantial Completion Date: The day the Engineer determines that the Contractor has achieved substantial completion.
