I <br /> Section 00 21 13 <br /> INSTRUCTIONS TO BIDDERS <br /> request. If City evaluation results in a change of the criteria,the <br /> City will issue an addendum to the bid documents identifying the <br /> ' new or revised criteria. Any protest of a City decision regarding <br /> a request for criteria modification must be in strict conformity <br /> with Everett Municipal Code Chapter 3.46, Bid Protest <br /> 111 Procedures. <br /> b. Additional Information. The City may from time to time require <br /> ' that the Bidder submit information in addition to the Bidder's <br /> Qualifications Statement. <br /> c. Appeal/Protest of Responsibility Decision. If the City <br /> determines the Bidder does not meet the bidder responsibility <br /> criteria above and is therefore not a responsible bidder,the City <br /> will notify the Bidder in writing with the reasons for its <br /> determination. If the Bidder disagrees with this determination, <br /> the Bidder may appeal to the City parks director by presenting <br /> additional information to the City parks director in writing <br /> within one business day after receipt of the City's <br /> determination. The City's parks director will consider the <br /> 1 additional information and will issue his decision regarding the <br /> appeal.Any protest by Bidder of the parks director's decision <br /> must be in strict conformity to Everett Municipal Code Chapter <br /> 3.46, Bid Protest Procedures, which (among other <br /> requirements) requires that any protest be filed with the City <br /> Clerk no later than the business day prior to the date of City <br /> Council proposed award or rejection of all bids. The City will not <br /> execute a contract with any other Bidder until two business <br /> days after the Bidder determined to be not responsible has <br /> received the parks director's decision or, if a protest is filed <br /> under Everett Municipal Code Chapter 3.46, until two business <br /> days after the Bidder receives written notice of City final <br /> determination of the protest. <br /> I <br /> B. PRE-AWARD CONFERENCE <br /> After Bid opening, but prior to award, the apparent successful Bidder shall attend a pre-award <br /> conference to respond to questions by the City regarding evaluation of Bids. The City will <br /> emphasize items such as insurance and bonding that will assist in prompt issuance of the Notice <br /> to proceed. By conducting a pre-award conference,the City has not thereby waived its right to <br /> make determinations regarding responsiveness and responsibility of the Bidder. <br /> C. ACCEPTANCE OF BID <br /> Within 60 days after the opening of Bids,the City will act either to accept the Bid from the lowest <br /> responsive, responsible Bidder, or to reject all Bids. The City reserves the right to request <br /> extensions of such Bid acceptance period. The acceptance of a Bid will be evidenced by a written <br /> Notice of Award of Contract delivered in person or by certified mail to the Bidder whose Bid is <br /> accepted, together with a request to furnish a performance and payment bond and evidence of <br /> ' insurance and to execute the Contract set forth in the Contract Documents. <br /> Rotary Park Renovation 7 of 11 <br /> I <br />
