ISection 00 21 13 INSTRUCTIONS TO BIDDERS <br /> I1.13 AWARD OF CONTRACT <br /> A. Evaluation of Bids <br /> 1 1. Bids will be evaluated by the City to determine which bid is the lowest <br /> responsive bid by a responsible bidder and which bid, if any, should be <br /> accepted in the best interest of the City. The City, in its sole discretion, <br /> reserves the right to accept or reject any and all bids submitted and to <br /> waive informalities and minor irregularities. <br /> I a. LOWEST: The City will award the Project to the responsive and <br /> responsible bidder whose Bid is the lowest. In accordance with <br /> RCW 39.04.380, if a bid is received from a nonresident contractor <br /> from a state that provides an in-state percentage bidding <br /> I preference and does not have an office located in Washington, <br /> then a comparable percentage disadvantage will be applied to the <br /> bid of that nonresident contractor. <br /> b. RESPONSIVENESS: City will consider all the material submitted <br /> by the bidder to determine whether it is in compliance with the <br /> I Contract Documents. The City reserves the right, at its discretion, <br /> to reject nonresponsive Bids. <br /> c. RESPONSIBILITY: <br /> 1 1) Mandatory Responsibility Criteria: RCW 39.04.350(1). It <br /> is the intent of City to award a contract to the lowest <br /> responsive and responsible Bidder. Before award, the <br /> I Bidder must meet the Bidder responsibility criteria under <br /> this Section to be considered a responsible Bidder. The <br /> Bidder may be required by the City to submit <br /> I documentation demonstrating compliance with the criteria <br /> under this Section. The Bidder must: <br /> a) Registration. Have a current certificate of <br /> Iregistration as a contractor in compliance with <br /> chapter 18.27 RCW, which must have been in <br /> effect at the time of bid submittal; and <br /> IIIb) UBI. Have a current Washington Unified Business <br /> Identifier(UBI) number. <br /> Ic) State Requirements. If applicable: <br /> (1) Have Industrial Insurance (workers' <br /> compensation) coverage for the bidder's <br /> I employees working in Washington, as <br /> required in Title 51 RCW; <br /> (2) Have a Washington Employment Security <br /> IDepartment number, as required in Title 50 <br /> RCW; <br /> I (3) Have a Washington Department of Revenue <br /> state excise tax registration number, as <br /> required in Title 82 RCW. <br /> 1 City of Everett 00 21 13-5 January 2022 <br /> Evergreen Pump Station Modifications <br /> UP3747-3 <br />
