Section 00 21 13 INSTRUCTIONS TO BIDDERS 111 <br /> d) Disqualification. Not be disqualified from bidding <br /> on any public works contract under RCW 39.06.010 <br /> or 39.12.065(3). <br /> e) Apprentices. If the Project is subject to the I <br /> apprenticeship utilization requirements in RCW <br /> 39.04.320, not have been found out of compliance <br /> by the Washington state apprenticeship and <br /> training council for working apprentices out of ratio, <br /> without appropriate supervision, or outside their <br /> approved work processes as outlined in their <br /> standards of apprenticeship under chapter 49.04 <br /> RCW for the one-year period immediately <br /> preceding the date of the bid solicitation. <br /> f) Within the three-year period immediately preceding <br /> the date of the bid solicitation, not have been <br /> determined by a final and binding citation and <br /> notice of assessment issued by the department of <br /> labor and industries or through a civil judgment <br /> entered by a court of limited or general jurisdiction <br /> to have willfully violated, as defined in RCW <br /> 49.48.082, any provision of chapter 49.46, 49.48, or <br /> 49.52 RCW. <br /> g) Unless Bidder has completed three or more public <br /> works projects and had a valid business license for <br /> 3 or more years, Bidder must have received <br /> Department of Labor and Industries training on the <br /> requirements related to public works and prevailing <br /> wage under RCW 39.12 and 39.04.350. <br /> 2) Supplemental Bidder Responsibility Criteria: RCW <br /> 39.04.350(2). If this Project is subject to supplemental <br /> bidder responsibility criteria, then such criteria will be <br /> contained in Section 00 22 13, Supplemental Instructions <br /> To Bidders. If there is no Section 00 22 13, Supplemental <br /> Instructions To Bidders in the bid package, then the Project <br /> is not subject to supplemental bidder responsibility criteria. <br /> d. BID PROTESTS: All protests by Bidders must be in accordance <br /> with Everett Municipal Code 3.46, "Bid Protest Procedures." <br /> B. Pre-Award Conference <br /> 1. After Bid opening, but prior to award, the apparent successful Bidder <br /> shall, if requested by the City, attend a pre-award conference to respond <br /> to questions by the City regarding evaluation of Bids. The City will <br /> emphasize items such as insurance and bonding that will assist in prompt <br /> issuance of the Notice to proceed.
