• otherwise, then such individual shall be deemed to have complied with the Fire Marshal Order if the said tenant or lessee immediately closes and secures said building, causes said premises to be vacated and locked, does not use or occupy said premises after receipt of such Fire Marshal Order, and takes such steps as may be reasonable to remove accumulations of com- bustible, explosive or otherwise hazardous materials. (d) Appeal and Appeal Board -- Any such Fire Marshal Order shall be forthwith complied with as set forth in said Order within the time or times therein prescribed. Any person upon whom such Order is served, may, within five days after the service of such Order, take an appeal of such Order and seek review thereof with the Fire Prevention Review Board. 1. There is hereby created a Fire Prevention Review Board, which Board shall be composed of the following officials of the City of Everett, to-wit: Commissioner of Safety, as chairman City Building Inspector Chief of the Everett Fire Department City Clerk of the City of Everett 2. Duties of the Clerk - It shall be the duty of the Clerk of the City of Everett, as a member of the said Fire Prevention Review Board, to have on hand in his office forms for appeal from such Fire Marshal Orders. The said Clerk shall keep a record of all such appeals, shall have authority to schedule hearings or dates for review of such Fire Marshal Orders before such Fire Pre- vention Review Board, and shall keep the records of the Fire Prevention Review Board, its sessions, the dates thereof, the members present and the witnesses heard giving testimony in each particular case. 3. Steps on Appeal - Any person upon whom such Fire Marshal Order has been served who desires to appeal the order therein set forth and review such order may do so, so long as such person shall comply with each and every step herein set forth, which jurisdictional steps are as follows : (a) File two copies of notice of appeal with the City Clerk of the City of Everett within five days after service of said Fire Marshal Order; and (b) Post the sum of $25.00 with the City Clerk to cover cost of appeal. -. In the event that any such person seeking a review before the Fire Prevention Review Board fails to comply with all of the steps herein set forth, then any member of said Fire Preven- tion Review Board or the City Attorney for the City of Everett may dismiss such appeal upon motion and if all of the steps for appeal have not been complied with, the appeal of such party shall be dismissed by the Fire Prevention Review Board.
