• <br /> otherwise, then such individual shall be deemed to <br /> have complied with the Fire Marshal Order if the said <br /> tenant or lessee immediately closes and secures said <br /> building, causes said premises to be vacated and <br /> locked, does not use or occupy said premises after <br /> receipt of such Fire Marshal Order, and takes such steps <br /> as may be reasonable to remove accumulations of com- <br /> bustible, explosive or otherwise hazardous materials. <br /> (d) Appeal and Appeal Board -- Any such Fire Marshal <br /> Order shall be forthwith complied with as set forth in <br /> said Order within the time or times therein prescribed. <br /> Any person upon whom such Order is served, may, within <br /> five days after the service of such Order, take an <br /> appeal of such Order and seek review thereof with the <br /> Fire Prevention Review Board. <br /> 1. There is hereby created a Fire Prevention <br /> Review Board, which Board shall be composed <br /> of the following officials of the City of <br /> Everett, to-wit: <br /> Commissioner of Safety, as chairman <br /> City Building Inspector <br /> Chief of the Everett Fire Department <br /> City Clerk of the City of Everett <br /> 2. Duties of the Clerk - It shall be the duty <br /> of the Clerk of the City of Everett, as a <br /> member of the said Fire Prevention Review <br /> Board, to have on hand in his office forms <br /> for appeal from such Fire Marshal Orders. <br /> The said Clerk shall keep a record of all <br /> such appeals, shall have authority to <br /> schedule hearings or dates for review of such <br /> Fire Marshal Orders before such Fire Pre- <br /> vention Review Board, and shall keep the <br /> records of the Fire Prevention Review Board, <br /> its sessions, the dates thereof, the members <br /> present and the witnesses heard giving <br /> testimony in each particular case. <br /> 3. Steps on Appeal - Any person upon whom such <br /> Fire Marshal Order has been served who desires <br /> to appeal the order therein set forth and <br /> review such order may do so, so long as such <br /> person shall comply with each and every step <br /> herein set forth, which jurisdictional steps <br /> are as follows : <br /> (a) File two copies of notice of appeal with <br /> the City Clerk of the City of Everett <br /> within five days after service of said <br /> Fire Marshal Order; and <br /> (b) Post the sum of $25.00 with the City Clerk <br /> to cover cost of appeal. <br /> -. In the event that any such person seeking a <br /> review before the Fire Prevention Review Board <br /> fails to comply with all of the steps herein <br /> set forth, then any member of said Fire Preven- <br /> tion Review Board or the City Attorney for the <br /> City of Everett may dismiss such appeal upon <br /> motion and if all of the steps for appeal have <br /> not been complied with, the appeal of such party <br /> shall be dismissed by the Fire Prevention Review <br /> Board. <br />
