a building, and in premises of any type of occupancy, <br /> notwithstanding the restrictions hereinafter provided <br /> for gravity oil burning systems. In all other respects <br /> oil burners to which oil fuel is delivered by pumping <br /> from an above-ground storage tank, shall comply with <br /> the requirements of this ordinance relating to oil <br /> burners connected to underground tanks. <br /> Oil burners and oil burning stoves which are <br /> designed to burn oil having flash point below one <br /> hundred twenty (120) degrees Fahrenheit and which are <br /> provided with an oil storage or supply tank having an <br /> oil capacity in excess of One (1) gallon are prohibited. <br /> It shall be unlawful for any person to use any such oil <br /> as a fuel or as a primer for on oil burner, in any oil <br /> burning systems using an oil supply tank of a capacity <br /> in excess of One (1) gallon. <br /> Section 4: That Section 5 of Ordinance No. 3043 of the <br /> City of Everett is hereby amended to read as follows: <br /> Section 5 : Gravity oil burners for installation <br /> in ranges , stoves, furnaces and other heating devices, <br /> and all oil burning equipment in connection therewith, <br /> shall comply with the following requirements of this <br /> section: <br /> (a) Only such gravity oil burners as have been <br /> inspected and approved by the Fire Chief as elsewhere <br /> herein provided, shall be offered for sale, installed <br /> or used within the City of Everett , Washington. <br /> (b) The Fire Chief may reject or disapprove <br /> any gravity oil burner which is not provided with <br /> adequate safeguards against fire or explosion or which <br /> is otherwise unsafe for use within the City Limits of <br /> Everett. <br /> (c) The recommendations and regulations per- <br /> taining to oil burners of the gravity type for install- <br /> ation in stoves, ranges and other heating devices as <br /> provided, from time to time, by the National Board of <br /> Fire Underwriters, and the standards of construction as <br /> promulgated by Underwriters' Laboratories, or by any <br /> other organization of equivalent standing'properly <br /> equipped and qualified for experimental testing, may be <br /> accepted by the Fire Chief, as prima facie evidence that <br /> any gravity oil burner complying with such regulations <br /> is safe for use within the City of Everett and the Fire <br /> Chief may, at his discretion, permit the installation <br /> and use of any such gravity oil burner, subject to the <br /> special provisions herein provided. <br /> (d) No gravity oil burner having an oil supply <br /> tank of a capacity exceeding Twelve (12) gallons , shall <br /> be installed or used in any portion of a building used <br /> for the purpose of a hotel, apartment house or assembly <br /> hall, or a rooming house , boarding house, school, <br /> theater, church, department store, or a place of refuge <br /> or detention, or in any portion of a waterfront building <br /> extending over the waters of Everett harbor or river. <br />
