serving the same route and traveling in the same direction. <br /> Section 2 The authority, right, privilege and franchise is hereby grant- <br /> NATURE OF <br /> GRANT ed to the company, its successors and assigns , for a period <br /> of twenty-five years from and after the date of acceptance by <br /> the company of this Ordinance, to establish, maintain and <br /> operate a motor bus service for the transportation for hire of <br /> passengers only, by vehicles propelled by power generated by <br /> gasoline, oil, electricity or otherwise , over and upon the <br /> streets of the city ; all in accordance with the terms, con- <br /> ditions and provisions of this Ordinance. <br /> Section 3 Operation under this franchise shall be upon and along certain <br /> ROUTES <br /> designated routes which may from time to time be established, <br /> changed, extended, shortened or abandoned as the convenience <br /> of the public and the demands for transportation may require <br /> and as designated or approved by the State of Washington <br /> acting by or through any department having jurisdiction thereof, <br /> and on charter trips not following fixed routes. <br /> Franchise holder agrees to act in cooperation with the City of <br /> Everett in the establishment, alteration or abandonment of all <br /> regular routes, subject to the approval of the state of Wash- <br /> ington acting by or through any department having jurisdiction <br /> thereof. <br /> The city shall maintain the streets used by the company in <br /> suitable condition for its operations, but for failure so to <br /> do the City shall in no event be held liable for damages, nor <br /> shall the City be deemed to have violated this requirement if <br /> it shall provide the nearest available passable parallel <br /> street as the route over which said company may temporarily <br /> operate. <br /> -2- <br />
