2. Approve all real estate documents provided by the CITY and prepared by the <br /> CONSULTANT using the most current WSDOT local program agency forms that are <br /> consistent with CITY acquisition practices. <br /> 3. Approve a minimum of one (1) preliminary offer package prior to the offers being made. <br /> 4. Provide review and written approval for all administrative settlements agreed to by the <br /> CITY. <br /> 5. Approve all landowner payments. <br /> 6. Make prompt payment to the owner or escrow company for all approved acquisitions. <br /> 7. Review and approve all transmitted files prepared by the CONSULTANT. <br /> Assumptions: <br /> 1. CONSULTANT shall follow the Uniform Relocation Act, WSDOT Local Agency Guidelines <br /> (LAG) manual, all applicable State and Local laws and CITY administrative rules for ROW <br /> acquisition for all real estate services provided for this project. <br /> 2. City will provide the CONSULTANT with available project information such as, but not <br /> limited to, the CITY's WSDOT approved ROW procedures, if available. <br /> 3. The CONSULTANT's title review responsibilities shall be to identify the correct vesting from <br /> the last recorded vesting deed and inputting that information into the appropriate acquisition <br /> documents. <br /> 4. CONSULTANT shall make the initial offer to purchase in person if possible, or by certified <br /> mail. During the COVID-19 period, CONSULTANT will also send offers via email or regular <br /> mail in addition to certified mail. <br /> 5. If in-person meetings are requested by the property owner, CONSULTANT will follow <br /> COVID-19 safety protocols as outlined in CONSULTANT'S project safety plan. <br /> 6. CONSULTANT shall provide a maximum of three (3) good faith attempts at acquisitions for <br /> up to five (5) parcels assigned, with those attempts being defined as an in-person visit with <br /> landowner (physical or virtual), a detailed phone conversation, or a substantive <br /> correspondence or email exchange. <br /> 7. CONSULTANT's acquisition duties shall be deemed complete if any of the following occur: <br /> A. A negotiated settlement approved by the CITY is reached and the necessary closing <br /> documents are executed. <br /> B. A new appraisal or offer is required. <br /> C. The offer to purchase is rescinded. <br /> D. A Possession & Use Agreement (P&U) is secured and the acquisition file is transmitted <br /> to CITY. <br /> E. A negotiated settlement cannot be reached after the third good faith attempt. <br /> i. If an impasse is reached during negotiations, the entire parcel file shall be turned <br /> over to the CITY for further action, including determination to eliminate acquisition of <br /> property or move forward with condemnation proceedings. <br /> 8. If negotiations cannot be concluded within seventy-five (75) days of the offer date on any <br /> given parcel or if an appraisal is requested by a landowner of any AOS parcel then the <br /> City of Everett <br /> Edgewater Bridge 5 Scope of Services <br />
