Y w <br /> • <br /> • <br /> or semi-trailer, or any combination of the same, whether loaded or <br /> unloaded, which fails to comply with, or in any manner is contrary <br /> to said provisions is hereby declared to be, and shall be prosecuted <br /> as, a violation of the provisions of this section. <br /> Section 145: SPEED AND WEIGHT UPON CERTAIN STREETS, ETC. <br /> It shall be unlawful for any person to operate a vehicle or any <br /> combination of vehicles over any bridge, elevated structure, through <br /> any tunnel or underpass, or over any street constituting a part of <br /> any public highway within the city, at a rate of speea or with a <br /> gross weight, or of a size which is greater at any time than the <br /> maximum speed or maximum weight or size which can be maintained or <br /> carried with safety over any such bridge or structure or through <br /> any such tunnel or underpass or over any street when such bridge, <br /> structure, tunnel, underpass or street is sign posted as hereinafter <br /> provided. The Commissioner of Public Works, in conjunction with <br /> the Chief of Police, may restrict the speed which may be maintained <br /> or the gross weight or size which may be operated upon or over <br /> any such bridge or elevated structure or through any such tunnel <br /> or underpass or over any such street with safety thereto; and shall <br /> cause suitable signs stating such maximum speed or maximum gross <br /> weight or size, or either, to be erected and maintained in each <br /> end of the portion of any public highway affected thereby, and no <br /> such ordinance or resolution shall be effective unless and until <br /> such signs are erected and maintained. <br /> Section 146: SPECIAL PERIVII1S. The Chief of Police may, <br /> upon application in writing and good cause being shown therefore, <br /> issue a special permit in writing authorizing the applicant to operate <br /> or move a vehicle or combination of vehicles of a size, weight <br /> of vehicle or load exceeding the maximum specified in this ordinance, <br /> or otherwise not in conformity with the provisions of this ordinance, <br /> and is further authorized to determine and to specify in such <br /> permit the route to be traversed. It shall be unlawful for any <br /> person to misrepresent the size or weight of any load in obtaining <br /> a permit or fail to follow the requirements and conditions of the <br /> permit or to operate any overlegal vehicle without first obtaining <br /> such permit. <br /> Section 147: SIGHING AND LIGHTENING OF VEHICLES. Any <br /> peace officer is authorized to require the operator of any vehicle <br /> or combination of vehicles to stop and submit to a weighing of the <br /> same either by means of a portable or stationary scale and may <br /> require that such vehicle be driven to the nearest public scale. <br /> `tJhenever a peace officer, upon weighing a vehicle and <br /> load, as above provided, determines that the weight is unlawful, <br /> such officer may, in addition to any other penalty provided, require <br /> the driver to stop the vehicle in a suitable place and remain stand- <br /> ing until such portion of the load is removed as may be necessary <br /> to reduce the gross weight of such vehicle to such limit as permitted <br /> by law. All materials unloaded shall be cared for by the owner <br /> or operator of such vehicle at the risk of such owner or operator. <br /> It shall be unlawful for any operator of a vehicle to <br /> fail or refuse to stop and submit the vehicle and load to g weighing, <br /> or to fail or refuse, when directed by an officer upon a weighing <br /> of the vehicle to stop the vehicle and otherwise comply with the <br /> provisions of this section. <br /> -43- <br />
