• <br /> • <br /> (b) To lend to, or knowingly permit the use of by one <br /> not entitled thereto, any vehicle operator ' s license issued to the <br /> person so lending or permitting the use thereof; <br /> (c) To display or to represent as one ' s own any vehicle <br /> operator ' s license not issued to the person so displaying the same ; <br /> (d) To fail or refuse to surrender to any court, peace <br /> or traffic officer, or the director of licenses upon demand, aiy <br /> vehicle operator 's license on notice that the same has been suspended, <br /> canceled or revoked as provided by law; <br /> (e) For any person who has been provided with a restricted <br /> or conditional operator 's license to operate a motor vehicle upon <br /> any public highway unless such person is at the time complying <br /> with such condition as stated thereon. <br /> section 161: CIANDATORY REVOCA 'ION OF OPERATOR LICENSE - <br /> DUTIES OF COURT. <br /> (a) Every court in fixing the penalty shall forthwith <br /> revoke the vehicle operator 's license of any person upon the <br /> conviction of such person of any of the following: <br /> 1. Conviction or forfeiture of bail upon three (3) <br /> charges of reckless driving all within the preceding two (2) years ; <br /> 2. A conviction of an operator of a motor vehicle, <br /> involved in an accident resulting in the death or injury of another <br /> person upon a charge of failing to stop and disclose his identity <br /> at the scene of the accident; <br /> 3. Operating any vehicle upon the public highways <br /> of this state while under the influence of or affected by the use <br /> of intoxicating liquor or of any narcotic drug; <br /> (b) Whenever the vehicle operator 's license of any person <br /> is suspended, revoked or cancelled for any violations, the judge <br /> passing such sentence shall forthwith secure the immediate <br /> forfeiture of the vehicle operator ' s license of such convicted <br /> person and immediately forward such vehicle operator 's license to <br /> the director of licenses, and on failure of such convicted person <br /> to deliver up such vehicle operator 's license the judge shall cause <br /> such person to be confined for the period of such suspension, <br /> revocation or cancellation or until such vehicle operator ' s license <br /> is delivered up to such judge; Provided, in the event such convicted <br /> person shall testify that he does not and at the time of the <br /> offense did not have a current and valid vehicle operator 's license, <br /> then the judge shall cause such person to be charged with the <br /> operation of a motor vehicle without a current and valid operator ' s <br /> license and on conviction punished as by law provided: Provided, <br /> also, that in the event that the vehicle operator' s license of such <br /> convicted person has been lost or destroyed and such convicted <br /> person shall make an affidavit to that effect, sworn to before the <br /> judge, he shall not be so confined to forfeit the same. <br /> -48- <br />
