4 r <br /> • <br /> CHAPTER XII <br /> MISCELLANEOUS PROVISIONS <br /> Section 166: IMPOUNDING OF VEHICLES. <br /> (a) Any vehicle parked in such a position that it <br /> constitutes an obstruction to traffic or is unlawfully parked in any <br /> prohibited or restricted area, or is parked or so used as to endanger <br /> or likely to endanger any user or potential user of any public <br /> highway, or used in violation of the traffic ordinances of the city <br /> of Everett or of any rule or regulation promulgated in connection <br /> therewith by the Chief of Police acting in conjunction with the <br /> city council, is hereby declared to be a nuisance. Such nuisance <br /> may be summarily abated by removing the vehicle by or under the <br /> direction of a police officer by means of towing or otherwise. <br /> (b) In the event that an operator of a vehicle is arrested <br /> and placed in custody and is not in condition to drive the vehicle <br /> to a place of safety and there is no other person present who may <br /> properly act as agent for such operator to drive the vehicle to a <br /> place of safety, or the operator of a vehicle is incapacitated <br /> as the result of an accident and is unable to care for his property, <br /> and there is no other person present who may properly act as agent <br /> for such operator in the care of his vehicle, any officer at the <br /> scene of such arrest or accident is hereby authorized to provide <br /> for the removal of such vehicle to a place of safety. <br /> (c) All towing ana storage charges on each vehicle impounded <br /> as provided in this section shall be paid by the owner or his agent <br /> if said vehicle be redeemed. The impounding of a vehicle shall <br /> not prevent or preclude the institution and prosecution of criminal <br /> proceedings in the police court, or elsewhere, charging the violator <br /> with any violation of the law on account of which such vehicle <br /> was impounded. <br /> Section 167: DRIPPING OIL, ETC. , ON STREETS. No oil, <br /> gasoline or like fluid shall be spilled or allowed to drop from <br /> any vehicle on any paved street or public way in the city of Everett. <br /> If the spilling of oil, gasoline or like fluid creates a fire <br /> hazard, any peace officer or member of the fire department is <br /> authorized to provide for the removal of the vehicle, from which such <br /> oil, gasoline or like fluid is spilled or dropped, to a place of <br /> safety under the provisions of section / 4 63 of this ordinance. <br /> Section 168: ABANDONED VEHICLES. Any vehicle abandoned <br /> upon any public highway of the city of Everett is hereby declared <br /> to be a nuisance subject to summary abatement by removal from the <br /> highway by or under the direction of the Chief of Police of the <br /> city of Everett to a place of storage. Such abandoned vehicles <br /> shall be disposed of as provided by section 143 of the Washington <br /> Motor Vehicle ti.ct. <br /> -51- <br />
