I <br /> 1 1-07.GR1 <br /> II <br /> 2 Legal Relations and Responsibilities to the Public <br /> 3 <br /> 4 GLF 1-07.1.docx <br /> 1 5 1-07.1 Laws to be Observed <br /> 6 (October 1, 2005 APWA GSP & City of Everett) <br /> 7 <br /> I 8 Supplement this section with the following: <br /> 9 <br /> 10 In cases of conflict between different safety regulations, the more stringent regulation <br /> 11 shall apply. <br /> 12 <br /> 13 The Washington State Department of Labor and Industries shall be the sole and <br /> 14 paramount administrative agency responsible for the administration of the provisions of <br /> I15 the Washington Industrial Safety and Health Act of 1973 (WISHA). <br /> 16 <br /> 17 The Contractor shall maintain at the project site office, or other well known place at the <br /> I 18 project site, all articles necessary for providing first aid to the injured. The Contractor <br /> 19 shall establish, publish, and make known to all employees, procedures for ensuring <br /> 20 immediate removal to a hospital, or doctor's care, persons, including employees, who <br /> I 21 may have been injured on the project site. Employees should not be permitted to work <br /> 22 on the project site before the Contractor has established and made known procedures <br /> 23 for removal of injured persons to a hospital or a doctor's care. <br /> I 24 <br /> 25 The Contractor shall have sole responsibility for the safety, efficiency, and adequacy of <br /> 26 the Contractor's plant, appliances, and methods, and for any damage or injury resulting <br /> I 27 from their failure, or improper maintenance, use, or operation. The Contractor shall be <br /> 28 solely and completely responsible for the conditions of the project site, including safety <br /> 29 for all persons and property in the performance of the work. This requirement shall apply <br /> 30 continuously, and not be limited to normal working hours. The required or implied duty of <br /> I31 the Engineer to conduct construction review of the Contractor's performance does not, <br /> 32 and shall not, be intended to include review and adequacy of the Contractor's safety <br /> 33 measures in, on, or near the project site. <br /> I 34 <br /> 35 The Contractor shall be in compliance at all times with all governmental laws, <br /> 36 regulations, requirements, and orders relating to COVID-19 applicable to the Work, <br /> I <br /> 37 including without limitation OSHA, L&I or other safety rules relating to COVID-19 and <br /> 38 COVID-19 gubernatorial proclamations and orders. These laws, regulations, <br /> 39 requirements, and orders are referred to as "COVID-19 Requirements." <br /> I 40 Contractor's Bid includes all costs necessary for the duration of the Work for compliance <br /> 41 with COVID-19 Requirements. Contractor's Bid takes into account that COVID-19 <br /> 42 Requirements may create direct and indirect costs, including inefficiency and delay. <br /> 43 Contractor shall have no entitlement to an equitable adjustment or other increase to the <br /> I 44 Contract Sum for any direct or indirect costs (including without limitation delay, <br /> 45 cumulative impact, inefficiency or ripple costs) incurred by the Contractor to comply with <br /> 46 COVID-19 Requirements. <br /> I 47 <br /> 48 <br /> 49 <br /> I <br /> 2022 PAVEMENT MAINTENANCE OVERLAY PAGE 17 OF 85 SPECIALS <br /> IWORK ORDER 3764 FEBRUARY 23,2022 <br />
