M <br /> Shoreline Master Program Regulations:The project will be required to comply with the goals, <br /> objectives, policies,and regulations in the Shoreline Master Program (SMP)and the Shoreline <br /> Management Act (SMA). However,there are hundreds of goals,objectives, policies, and regulations in <br /> the SMP,only those regulations found to be the most applicable are referenced below. <br /> SMP CHAPTER 3:GENERAL SHORELINE REQUIREMENTS <br /> Shoreline Use Element <br /> Regulation#2.All shoreline development and activities shall comply with the City's noise <br /> regulations, both during and after construction.The City may require the applicant to prepare noise <br /> studies to determine if a proposal is in conformance with the regulations. <br /> Regulation#4.All shoreline developments shall be located, constructed and operated so as not to <br /> be a hazard to public health and safety. <br /> Staff Findings:The off-leash dog area shall comply with the City's noise regulations and shall not be <br /> a hazard to public health and safety. <br /> Cultural Resources Element <br /> Regulation#1.All shoreline permits shall contain provisions which require developers to <br /> immediately stop work and notify the City and the Tulalip Tribes if anything of possible <br /> archaeological interest is uncovered during excavations or development and consult a professional <br /> archaeologist in inspect and evaluate the site. Failure to comply with this requirement shall be • <br /> considered a violation of the Shoreline permit. <br /> Regulation#6.Archaeological sites located both in and outside the shoreline jurisdiction are subject <br /> to RCW 27.44(Indian Graves and Records) and RCW 27.53 (Archaeological Sites and Records) and <br /> shall comply with WAC 25-48, as well as provisions of this SMP. <br /> Staff Findings:While digging the fence post holes action must immediately stop and notification <br /> must be given to the City and the Tulalip Tribes if any possible archaeological interest is uncovered. <br /> Flood Hazard Prevention Element <br /> Regulation#2.All development in the Flood Fringe and Floodway overlay zones shall comply with <br /> EMC 19.30,as applicable. <br /> Staff Findings: Prior to the issuance of this decision document,Ordinance 3759-20 was adopted and <br /> went into effect removing flood overlay zones.
