CITY OF EVERETT SPECIAL PROVISIONS ' <br /> 1-01 DEFINITIONS AND TERMS <br /> 1-01.3 Definitions ' <br /> Delete the three paragraphs under the heading Completion Dates, and substitute the <br /> following: <br /> Substantial Completion Date: The day the Engineer determines the City has full and <br /> unrestricted use and benefit of the facilities, both from the operational and safety <br /> standpoint, any remaining traffic disruptions will be rare and brief, and only minor <br /> incidental work, replacement of temporary substitute facilities, plant establishment <br /> periods, or correction or repair remains for the Physical Completion of the total Contract. <br /> Physical Completion Date: The day all of the Work is physically completed on the <br /> project. All documentation required by the Contract and required by law does not <br /> necessarily need to be furnished by the Contractor by this date. <br /> Completion Date: Date on which Project is ready for Final Acceptance. All physical <br /> work, including Punch List, is complete and Contractor has completed and fulfilled all <br /> contractual obligations except any maintenance of landscaping. Contractual obligations <br /> that must be fulfilled prior to achievement of the Completion Date include, and are not <br /> limited to; the Contractor's furnishing all documentation, including correct, complete and <br /> accurate as-built or record drawings and operation and maintenance manuals and <br /> transfer of warranties. <br /> (This definition replaces the definition in WSDOT 1-01.3 for Completion Dates.) <br /> Revise the following definitions to read as follows: <br /> Award: The decision by Everett City Council to award a contract and authorize the <br /> Mayor to sign the Contract. No contract is formed until the Mayor signs the contract. <br /> (This definition replaces the definition in WSDOT 1-01.3 for Bid Documents.) <br /> Bid Documents: The component parts of the proposed Contract which may include, <br /> but are not limited to, the Proposal Form, the proposed Contract Provisions, the ' <br /> proposed Contract Plans, and Addenda. (This definition replaces the definition in <br /> WSDOT 1-01.3 for Bid Documents.) <br /> Contract: Written agreement signed between the City and Contractor and includes <br /> Division C — CONTRACT, Division P - PROPOSAL, Division B — BID ITEM <br /> DESCRIPTIONS, Special Provisions, Contract Plans, Standard Specifications and <br /> amendments, Standard Plans in effect as of the date Bids are opened, Addenda, <br /> supplemental agreements, change orders, certifications and affidavits required by this <br /> Contract and by law, and Federal requirements that apply to this Contract and Project. <br /> (This definition replaces the definition in WSDOT 1-01.3 for Contract.) <br /> Contract Bond(s): Include a separate performance bond and payment bond, as set <br /> forth in the Contract Documents. (This definition supplements the definition in WSDOT <br /> 1-01.3 for Contract Bond.) <br /> Engineer: The City's representative who administers the construction program for the <br /> City. Provisions in the Contract Documents that state the Engineer"shall" or"will" shall <br /> be deemed to mean that the Engineer shall or will take such action if requested in writing <br /> by the Contractor. (This definition replaces the definition in WSDOT 1-01.3 for <br /> Engineer.) <br /> Specifications: Includes 2021 WSDOT/APWA Standard Specifications and latest <br /> Amendments, and all other specifications (including these Special Provisions) for the <br /> prescribed Work in this Contract.
