by the applicant at the north and south ends of the path indicating these facilities may be <br /> used by the general public. <br /> 31 When submitting for building permit approval, the plan set shall include a detailed <br /> landscaping plan which meets landscaping requirements of the zoning code — <br /> Landscape Category A. The plan shall be at an appropriate scale and identify species, <br /> size, quantity, location and planting details. The landscaping must be complete prior to <br /> issuance of a certificate of occupancy. A two year maintenance security will be required <br /> for site landscaping. All landscaping shall be maintained by the condominium <br /> association whether the landscaping is located on common parcels or individual lots. <br /> The binding site plan lot configuration may be modified if the applicant chooses to have <br /> all landscaped areas within common ownership. <br /> 32. The wetland/stream buffer restoration shall be provided with plans submitted for building <br /> permit issuance. The restoration plan shall be in accordance with Critical Areas Study <br /> and Stream Buffer Enhancement Plan prepared by Altmann Oliver Associates LLC <br /> (August 23, 2013). <br /> 33. Prior to issuance of permits and disturbance of wetland and buffer areas, the applicant <br /> shall provide to the city a financial assurance device to guarantee that all restoration <br /> work will be completed in accordance with the approved wetland/buffer mitigation plan. <br /> The amount of the assurance shall be 300% the estimated cost of completing the work. <br /> The applicant shall submit for review and acceptance a detailed estimate of such costs, <br /> including costs of installation, maintenance and monitoring. Upon successful completion <br /> of the restoration, the assurance device may be modified or otherwise replaced to <br /> provide for the 5 year monitoring and maintenance requirement. <br /> 34. The mitigation plan shall be fully implemented within twelve months of the date of <br /> issuance of building and or public works construction permits, or prior to issuance of a <br /> certificate of occupancy, whichever comes first. Deferral beyond that date of some <br /> planting may be approved by the Planning Department if necessary to wait to avoid <br /> unfavorable climate conditions for establishing new plantings. <br /> 35. If anything of possible archaeological interest is uncovered during excavations or <br /> development, the applicant must immediately stop work and notify the city and the <br /> Tulalip Tribes, and consult with a professional archaeologist who must inspect and <br /> evaluate the site. In the event that ground disturbing or other constructing activities <br /> result in the inadvertent discovery of the archaeological resources, work shall be halted <br /> in the immediate area, and contact made with the City of Everett, the office of the State <br /> Archaeologist (OAHP), and cultural resources office of the affected Tribes. Work must <br /> be halted until such time as further investigation and appropriate consultation is <br /> concluded. In the unlikely event of the inadvertent discovery of human remains, work <br /> shall be immediately halted in the discovery area, the remains covered and secured <br /> against further disturbance, and communication established with project administrative <br /> personnel, local law enforcement, OAHP, and authorized Tribal representatives. <br /> 36. Staging of construction equipment and materials shall stay out of the buffer area. <br /> Activities within the buffer shall be limited those necessary to implement the <br /> enhancement plan. <br /> 14 <br />
