A Proposal will be considered irregular and will be rejected if: , 9 a. The Bidder is not prequalified when so required; 10 b. The authorized Proposal form furnished by the Contracting Agency is not 11 used or is altered; 12 c. The completed Proposal form contains any unauthorized additions, deletions, i 13 alternate Bids, or conditions; 14 d. The Bidder adds provisions reserving the right to reject or accept the award, 15 or enter into the Contract; I 16 e. A price per unit cannot be determined from the Bid Proposal; 17 f. The Proposal form is not properly executed; 18 g. The Bidder fails to submit or properly complete a Subcontractor list, if I 19 applicable, as required in Section 1-02.6; 20 h. The Bidder fails to submit or properly complete a Disadvantaged Business 21 Enterprise Certification, if applicable, as required in Section 1-02.6; I 22 i. The Bidder fails to submit written confirmation from each DBE firm listed on 23 the Bidder's completed DBE Utilization Certification that they are in 24 agreement with the bidder's DBE participation commitment, if applicable, as 25 required in Section 1-02.6, or if the written confirmation that is submitted fails 26 to meet the requirements of the Special Provisions; 27 j The Bidder fails to submit DBE Good Faith Effort documentation, if applicable, 28 as required in Section 1-02.6, or if the documentation that is submitted fails to I 29 demonstrate that a Good Faith Effort to meet the Condition of Award was 30 made; 31 k. The Bidder fails to submit a DBE Bid Item Breakdown form, if applicable, as I 32 required in Section 1-02.6, or if the documentation that is submitted fails to 33 meet the requirements of the Special Provisions; 34 I. The Bidder fails to submit DBE Trucking Credit Forms, if applicable, as Il 35 required in Section 1-02.6, or if the documentation that is submitted fails to 36 meet the requirements of the Special Provisions; 37 m. The Bid Proposal does not constitute a definite and unqualified offer to meet I 38 the material terms of the Bid invitation; or 39 n. More than one Proposal is submitted for the same project from a Bidder 40 under the same or different names. 41 I 42 2. A Proposal may be considered irregular and may be rejected if: 43 a. The Proposal does not include a unit price for every Bid item; 44 b. Any of the unit prices are excessively unbalanced (either above or below the I 45 amount of a reasonable Bid) to the potential detriment of the Contracting 46 Agency; 47 c. Receipt of Addenda is not acknowledged; I 48 d. A member of a joint venture or partnership and the joint venture or 49 partnership submit Proposals for the same project (in such an instance, both 50 Bids may be rejected); or I 51 e.
