1 Advance Notification <br /> 2 The Contractor shall notify the Engineer in writing of any traffic impacts related to <br /> 3 lane closure, shoulder closure, sidewalk closure, or any combination for the week by <br /> 4 12:00 p.m. (noon) Wednesday the week prior to the stated impacts. <br /> 5 <br /> 6 The Contractor shall notify the Engineer in writing ten working days in advance of <br /> 7 any traffic impacts related to full roadway closure, ramp closure, or both. <br /> 8 <br /> 9 The Contractor shall notify the Engineer in writing of any changes to the stated traffic <br /> 10 impacts a minimum of 48 hours prior to the traffic impacts. <br /> 11 <br /> 12 1-07.24.RTF <br /> 13 1-07.24 Rights of Way <br /> 14 (July 23, 2015 APWA GSP) <br /> 15 <br /> 16 Delete this section and replace it with the following: <br /> 17 <br /> 18 Street Right of Way lines, limits of easements, and limits of construction permits are <br /> 19 indicated in the Plans. The Contractor's construction activities shall be confined within <br /> 20 these limits, unless arrangements for use of private property are made. <br /> 21 <br /> 22 Generally, the Contracting Agency will have obtained, prior to bid opening, all rights of <br /> 23 way and easements, both permanent and temporary, necessary for carrying out the <br /> 24 work. Exceptions to this are noted in the Bid Documents or will be brought to the <br /> 25 Contractor's attention by a duly issued Addendum. <br /> 26 <br /> 27 Whenever any of the work is accomplished on or through property other than public <br /> 28 Right of Way, the Contractor shall meet and fulfill all covenants and stipulations of any <br /> 29 easement agreement obtained by the Contracting Agency from the owner of the private <br /> 30 property. Copies of the easement agreements may be included in the Contract <br /> 31 Provisions or made available to the Contractor as soon as practical after they have been <br /> 32 obtained by the Engineer. <br /> 33 <br /> 34 Whenever easements or rights of entry have not been acquired prior to advertising, <br /> 35 these areas are so noted in the Plans. The Contractor shall not proceed with any portion <br /> 36 of the work in areas where right of way, easements or rights of entry have not been <br /> 37 acquired until the Engineer certifies to the Contractor that the right of way or easement is <br /> 38 available or that the right of entry has been received. If the Contractor is delayed due to <br /> 39 acts of omission on the part of the Contracting Agency in obtaining easements, rights of <br /> 40 entry or right of way, the Contractor will be entitled to an extension of time. The <br /> 41 Contractor agrees that such delay shall not be a breach of contract. <br /> 42 <br /> 43 Each property owner shall be given 48 hours notice prior to entry by the Contractor. This <br /> 44 includes entry onto easements and private property where private improvements must <br /> 45 be adjusted. <br /> 46 <br /> 47 The Contractor shall be responsible for providing, without expense or liability to the <br /> 48 Contracting Agency, any additional land and access thereto that the Contractor may <br /> 49 desire for temporary construction facilities, storage of materials, or other Contractor <br /> 50 needs.
