1 Except in the case of emergency or unless otherwise approved by the Engineer, the <br /> 2 normal working hours for the Contract shall be any consecutive 8-hour period <br /> 3 between 7:00 a.m. and 6:00 p.m. or as required by section F1-07.23(1). Monday <br /> 4 through Friday, exclusive of a lunch break. If the Contractor desires different than the <br /> 5 normal working hours stated above, the request must be submitted in writing prior to <br /> 6 the preconstruction conference, subject to the provisions below. The working hours <br /> 7 for the Contract shall be established at or prior to the preconstruction conference. <br /> 8 <br /> 9 All working hours and days are also subject to local permit and ordinance conditions <br /> 10 (such as noise ordinances). <br /> 11 <br /> 12 If the Contractor wishes to deviate from the established working hours,the Contractor <br /> 13 shall submit a written request to the Engineer for consideration. This request shall <br /> 14 state what hours are being requested, and why. Requests shall be submitted for <br /> 15 review no later than ***72 hours for day work and 30 days for night work*** prior to <br /> 16 the day(s) the Contractor is requesting to change the hours. <br /> 17 <br /> 18 A Noise Variance, which shall be provided by the City, is required for Contract <br /> 19 nighttime work and included as an appendix in these specifications. If the Contractor <br /> 20 or the Engineer requests to do nighttime work that is not already established in the <br /> 21 Contract, a 30-day notice is required. The Engineer will then review the request and <br /> 22 apply for the Noise Variance; the City can deny the request at its sole discretion. <br /> 23 Nighttime work is considered to be between 10 pm and 7 am unless otherwise stated. <br /> 24 The following mitigation measures shall be in effect during a Noise Variance, though <br /> 25 there may be additional project specific requirements: <br /> 26 • Back-up alarms shall be directional broad band type alarms. <br /> 27 • Trucks performing export haul shall have well maintained bed liners. <br /> 28 • Tailgate slamming will be prohibited. <br /> 29 • No construction work shall be allowed between 6 pm and 8 am on Saturdays, <br /> 30 Sundays, or federally recognized holidays unless otherwise stated in the <br /> 31 Noise Variance Permit. <br /> 32 <br /> 33 If the Contracting Agency approves such a deviation, such approval may be subject <br /> 34 to certain other conditions, which will be detailed in writing. For example: <br /> 35 <br /> 36 1. On non-Federal aid projects, requiring the Contractor to reimburse the <br /> 37 Contracting Agency for the costs in excess of straight-time costs for <br /> 38 Contracting Agency representatives who worked during such times. (The <br /> 39 Engineer may require designated representatives to be present during the <br /> 40 work. Representatives who may be deemed necessary by the Engineer <br /> 41 include but are not limited to: survey crews; personnel from the Contracting <br /> 42 Agency's material testing lab; inspectors; and other Contracting Agency <br /> 43 employees or third party consultants when, in the opinion of the Engineer, <br /> 44 such work necessitates their presence.) <br /> 45 2. Considering the work performed on Saturdays, Sundays, and holidays as <br /> 46 working days with regard to the contract time. <br /> 47 3. Considering multiple work shifts as multiple working days with respect to <br /> 48 contract time even though the multiple shifts occur in a single 24-hour period. <br /> 49 4.
