Property owner releases per Section 1-07.24 <br /> 2 <br /> 3 1-08.9.INST3.GR1. <br /> 4 Section 1-08.9 is supplemented with the following: <br /> 5 <br /> 6 F1-08.9.OptionA.RTF.docx <br /> 7 1-08.9 Liquidated Damages <br /> 8 (March 3, 2021 APWA GSP, Option A) <br /> 9 <br /> 10 Replace Section 1-08.9 with the following: <br /> 11 <br /> 12 Time is of the essence of the Contract. Delays inconvenience the traveling public, <br /> 13 obstruct traffic, interfere with and delay commerce, and increase risk to Highway users. <br /> 14 Delays also cost tax payers undue sums of money, adding time needed for <br /> 15 administration, engineering, inspection, and supervision. <br /> 16 <br /> 17 Accordingly, the Contractor agrees: <br /> 18 <br /> 19 1. To pay liquidated damages in the amount of*** $6,900 ***for each working <br /> 20 day beyond the number of working days established for Physical Completion, <br /> 21 and <br /> 22 <br /> 23 2. To authorize the Engineer to deduct these liquidated damages from any <br /> 24 money due or coming due to the Contractor. <br /> 25 <br /> 26 When the Contract Work has progressed to Substantial Completion as defined in the <br /> 27 Contract, the Engineer may determine the Contract Work is Substantially Complete. The <br /> 28 Engineer will notify the Contractor in writing of the Substantial Completion Date. For <br /> 29 overruns in Contract time occurring after the date so established, liquidated damages <br /> 30 identified above will not apply. For overruns in Contract time occurring after the <br /> 31 Substantial Completion Date, liquidated damages shall be assessed on the basis of <br /> 32 direct engineering and related costs assignable to the project until the actual Physical <br /> 33 Completion Date of all the Contract Work. The Contractor shall complete the remaining <br /> 34 Work as promptly as possible. Upon request by the Project Engineer, the Contractor <br /> 35 shall furnish a written schedule for completing the physical Work on the Contract. <br /> 36 '37 Liquidated damages will not be assessed for any days for which an extension of time is <br /> 38 granted. No deduction or payment of liquidated damages will, in any degree, release the <br /> 39 Contractor from further obligations and liabilities to complete the entire Contract. <br /> 40 <br /> 41 1-09.2(5).RTF <br /> 42 1-09.2(5) Measurement <br /> 43 (May 2, 2017 APWA GSP) <br /> 44 <br /> 45 Revise the first paragraph to read: <br /> 46 <br /> 47 Scale Verification Checks —At the Engineer's discretion, the Engineer may perform <br /> 48 verification checks on the accuracy of each batch, hopper, or platform scale used in <br /> 49 weighing contract items of Work. <br /> 50 <br /> 2023 FEDERAL OVERLAY <br /> FEDERAL AID#STBGUL-2715(011) <br /> WO#3788 March 2,2023 SP-60 <br />
