City of Everett 00 68 00 -2 <br /> 3. SUBCONTRACTORS <br /> The Contractor shall include the apprentice utilization requirements of this Specification 006800 <br /> in all subcontracts executed for the Project and ensure that all subcontractors working on the <br /> Project are notified of the apprentice utilization requirements. The Contractor is responsible for <br /> using good faith efforts to meet the apprentice utilization requirements of the Contract, including <br /> overall compliance on all contract labor hours worked by subcontractors. <br /> 4. CHANGES TO THE APPRENTICE UTILIZATION REQUIREMENT <br /> 4.1 If the Contractor determines during the term of the Contract that it will be unable to meet <br /> the apprentice utilization goal, the Contractor must ask the City in writing to modify the <br /> goal. The request shall include documentation of the Contractor's affirmative efforts to <br /> use apprentices registered with the Washington State Apprenticeship and Training <br /> Council ("SAC"), including copies of correspondence between the Contractor and the <br /> SAC approved apprentice programs, union locals, FAST Jobs Coalition, and others. <br /> 4.2 Bases for modification of goal include, but are not limited to: <br /> 4.2.1 A lack of availability of apprentices; <br /> 4.2.2 A disproportionately high ratio of material costs to labor hours, which does not <br /> make feasible the required minimum levels of apprentice participation; <br /> 4.2.3 Participating contractors have demonstrated a good faith effort to comply with the <br /> requirements of this resolution; or <br /> 4.2.4 Other criteria deemed appropriate by the City in its sole discretion. <br /> 4.3 City shall evaluate the request, and if appropriate, a change order shall be prepared by <br /> City authorizing modification of the apprentice utilization goal. If City determines that a <br /> modification is not justified, City shall communicate the decision in writing to the <br /> Contractor. <br /> 5. MONTHLY APPRENTICE UTILIZATION REPORT <br /> 5.1 With each Request for Progress Payment, the Contractor shall submit to City a Monthly <br /> Apprentice Utilization Report in an electronic format to be provided by City, for the <br /> Contractor and all subcontractors. The Contractor and all subcontractors performing <br /> work on the Project during the reporting period shall complete and submit the Monthly <br /> Apprentice Utilization Report. The report shall accompany the Contractor's Request for <br /> Progress Payment. A Request for Progress Payment that is not accompanied by the <br /> Monthly Apprenticeship Utilization Report will not be processed for payment until said <br /> Monthly Apprenticeship Utilization Report is received and approved by City. <br /> 5.2 The Contractor shall be responsible for reporting apprentice utilization data required by <br /> City beginning with the first day of work for each apprentice.
