If Contractor's solution(s) impact the Contract <br /> Time or the Contract Sum, Contractor shall state impact in the ASI. <br /> 10. Contractor's signature. <br /> 11. Attachments: Include drawings, descriptions, measurements, photos, Product <br /> Data, Shop Drawings, and other information necessary to fully describe items <br /> needing interpretation. <br /> 1.6 NON-CONFORMING WORK <br /> A. Non-Conforming Work: Work found defective, or in any way not in accordance with <br /> the requirements of the Contract Documents, is defined as non-conforming Work. <br /> B. Procedure: Architect will bring non-conforming work to the attention of the Owner and <br /> Contractor either verbally and/or by written notification. It is the expectation that the <br /> Contractor will take timely, corrective action on non-conforming work. Upon receipt of <br /> notification of non-conforming work, the Contractor shall take immediate action to <br /> assess the non-conformance and resolve the Work to the Architect's satisfaction, or <br /> remove and replace with conforming Work at Contractor's expense and with no <br /> increase in Contract Time. Non-conforming work shall be tracked in the construction <br /> progress meeting minutes until resolved, corrective actions for non-conforming Work <br /> shall be discussed at construction progress meetings and all non-conforming work shall <br /> be completed in a timely manner, but no later than prior to Final Completion. <br /> C. Where non-conforming Work requires re-design by the Architect or additional testing by <br /> the Owner's testing agency, such re-design and testing costs shall be borne by the <br /> Contractor. <br /> 1.7 COORDINATION <br /> A. General Coordination: <br /> 1. The Contractor shall be in charge of this Contract and the Project, as well as directing <br /> and scheduling of all Work. Final responsibility for performance, interface, and <br /> completion of the Project shall be the Contractor's. <br /> a. Anticipate interrelationship of all Subcontractors and their relationship with the <br /> total Work. <br /> b. Resolve differences or disputes between Subcontractors and materials <br /> suppliers concerning coordination, interference, or extent of the Work. <br /> Contractor's decisions, if consistent with Contract Document requirements, shall <br /> be final. <br /> 2.
