§ 7.4 Costs of Materials and Equipment Incorporated in the Completed Construction
<br /> § 7.4.1 Costs,including transportation and storage at the site,of materials and equipment incorporated,or to be
<br /> incorporated, in the completed construction,except costs of on-site storage and handling of materials,which are
<br /> included under Specified General Conditions.
<br /> § 7.4.2 Costs of materials described in the preceding Section 7.4.1 in excess of those actually installed to allow for
<br /> reasonable waste and spoilage.Unused excess materials,if any,shall become the Owner's property at the completion of
<br /> the Work or,at the Owner's option, shall be sold by the Construction Manager.Any amounts realized from such sales
<br /> shall be credited to the Owner as a deduction from the Cost of the Work.
<br /> §7.4.3 Notwithstanding the above,costs of material and equipment directly procured by the Construction Manager(and
<br /> not bid through a subcontract package)and incorporated in the completed construction will generally be included in
<br /> Negotiated Support Services.
<br /> § 7.5 Costs of Other Materials and Equipment, Temporary Facilities and Related Items
<br /> § 7.5.1 Costs of transportation,storage,installation,dismantling,maintenance,and removal of materials,supplies,
<br /> temporary facilities,machinery,equipment and hand tools not customarily owned by construction workers that are
<br /> provided by the Construction Manager at the site and fully consumed in the performance of the Work.Costs of
<br /> materials, supplies,temporary facilities,machinery,equipment,and tools,that are not fully consumed,shall be based on
<br /> the cost or value of the item at the time it is first used on the Project site less the value of the item when it is no longer
<br /> used at the Project site.Costs for items not fully consumed by the Construction Manager shall mean fair market value.
<br /> § 7.5.2 Rental charges(not to exceed local fair market costs)for temporary facilities,machinery,equipment,and hand
<br /> tools not customarily owned by construction workers that are provided by the Construction Manager at the site,and the
<br /> costs of transportation, installation,dismantling,minor repairs,and removal of such temporary facilities,machinery,
<br /> equipment,and hand tools.Rates and quantities of equipment owned by the Construction Manager,or a related party as
<br /> defined in Section 7.8,shall be subject to the Owner's prior approval.The total rental cost of any Construction
<br /> Manager-owned item may not exceed the lesser of the local fair market rental costs or seventy-five percent(75%)of the
<br /> purchase price of any comparable item.Rates of Construction Manager-owned equipment and quantities of equipment
<br /> shall be subject to the Owner's prior approval.
<br /> Rentals from the Construction Manager or any entity in which the Construction Manager or one or more of its owners
<br /> has a direct or indirect ownership interest("CM Equipment")shall be separately accounted for and the rental costs shall
<br /> not exceed the Rental Rate Blue Book by Data Quest, San Jose,California,or average fair market rental costs,
<br /> whichever are lower. If more than one rate is applicable,the best available rate will be utilized.The rates in effect at the
<br /> time of the performance of the Work are the maximum rates allowable for equipment of modern design and in good
<br /> working condition and include full compensation for furnishing all fuel,oil,lubrication,repairs,maintenance,and
<br /> insurance to the same extent as the comparable Blue Book or fair market rate.Equipment not of modern design and/or
<br /> not in good working condition will have lower rates. Hourly,weekly,and/or monthly rates,as appropriate,will be
<br /> applied to yield the lowest total cost.When rental rates payable do not include fuel, lubrication,maintenance and
<br /> servicing,as defined as operating costs in the Blue Book,such operating costs shall be reimbursed based on actual
<br /> costs.The rate for CM Equipment necessarily standing by for future use on the Work shall be 50%of the maximum rate
<br /> established above. If CM Equipment is required for which a rental rate is not established by the Blue Book,an agreed
<br /> rental rate shall be established for that equipment,which rate and use must be approved by the Owner prior to
<br /> performing the Work.Equipment drop-off and pick-up rates shall also be an average of fair market costs.
<br /> § 7.5.3 Costs of street cleaning(as a Negotiated Support Service),removal of rubbish and debris from the site of the
<br /> Work and its proper and legal disposal except when performed by a Subcontractor.A separate subcontract that
<br /> specifically requires progress cleaning,removal of rubbish and debris not normally included in a trade subcontract is not
<br /> a Cost of the Work.Any progress cleaning,rubbish and debris removal shall be performed under Negotiated Support
<br /> Services unless included as part of a trade subcontract scope identified above.
<br /> § 7.5.4 Costs of document reproductions,facsimile transmissions and long-distance telephone calls,postage and parcel
<br /> delivery charges,telephone service at the site and reasonable petty cash expenses of the site office are included in
<br /> Specified General Conditions and are not separately reimbursable,except for the costs of document reproduction for
<br /> subcontractor bidding which are a reimbursable Cost of the Work.
