re-topping existing asphalt pavement with asphalt concrete ; and also from Rockefeller Avenue to Walnut Street by the construction of Portland cement concrete curbs, curbs and gutters as necessary, paving alley crossings and replacement of concrete sidewalks to fit new work , making of the necessary changes at intersections , and the doing of all other work necessary to make a complete improvement, according to the plans and specifications prepared under the direction of the City Engineer, which plans and specifications are hereby adopted and approved. Section 2: That a sum not to exceed thirty (30/0) per cent of the cost and expense of such improvement , including all necessary incidental expenses, plus Clerk and Treasurer's fees, shall be borne by and assessed against the property included in the assessment district herein created , in accordance with law; and the balance of the cost thereof, including all necessary inci- dental expenses, shall be paid from funds allocated to the City of Lverett from the Washington State Motor Vehicle Fund and. by Federal grant made by the United States government. The City of Everett shall not be liable for any portion of the costs and expenses of such improvement in excess of the amount above mentioned , except as provided in Chapter 141, Session Laws of 19234: and Ordinance No. 2126 of the City of Everett. Section 3. There is hereby established a local improvement district, to be called Local Improvement District No. , which improvement dis- trict shall include the following described property, to-wit: All that property between Rockefeller Avenue and Walnut Street that lies between the north margin of 16th Street and a line Two Hundred (200' ) feet north and parallel thereto, also from the south margin of 16th Street and a line Two Hundred (200') feet south and paral- lel thereto , with the exception of Streets and Alleys. Section 4. A special fund is hereby created , to be called Local Im- provement District Fund No. mil" , which shall constitute in the aggre- gate of the several amounts assessed , levied and collected , on the several tra„ts and parcels of land in said Local Improvement District , and the pro- ceeds of the sale of the bonds of the said district for the purpose of de- fraying the costs and expenses of such improvement as described herein, to- gether with the funds allocated from the Jashington State Motor Vehicle r'und -2-
