and at such height that the meter and the fare shown thereon are clearly visible <br /> from the rear compartment of the taxicab. <br /> E. It is unlawful for any person owning, operating or driving a taxicab to authorize or <br /> operate such taxicab unless such taximeter is used in determining the fare to be <br /> charged, and no other or different fare shall be charged to the passenger than is <br /> recorded on the reading face of said taximeter for the trip. No other rates or <br /> methods of measuring the distance or time charged shall be allowed, except as <br /> provided in this ordinance. If a vehicle is operated as both a taxi and a special <br /> service vehicle,then the vehicle may have a dual meter providing one rate for when <br /> the vehicle functions as a taxi and a second rate for when the vehicle functions as a <br /> special service vehicle. <br /> F. It is unlawful to change the size of the wheels or tires of any taxicab or the gears <br /> operating the taximeter or to change the taximeter from one taxicab to another or <br /> to in any way tamper with the taximeter unless such taximeter is reinspected and <br /> approved as required by the chief of police before it is used, provided, however, <br /> that a licensee may change from regular to snow or studded tires without <br /> reinspection of the taximeter, so long as the change does not operate to increase <br /> the mileage registered by the taximeter. <br /> G. It is unlawful for any driver of a taxicab to activate the taximeter when the taxicab <br /> is not employed or fail to activate the meter at the beginning of each for-hire trip, <br /> unless the transportation is provided pursuant to a written contract as authorized in <br /> this ordinance. <br /> H. If the chief of police determines during his inspection that the condition of any <br /> taxicab or vehicle-for-hire needs correction, he/she shall issue to the operator or <br /> driver thereof a notice in writing specifying such defects and the same shall be <br /> remedied immediately or by a later date determined by the chief of police. <br /> I. It is unlawful to fail to comply with any written notice by the chief of police to <br /> make corrections on the taxicab or for-hire vehicle. <br /> Section 30: Rates. <br /> A. Except for special or contract rates and rates for special service vehicles, as <br /> provided for in this ordinance, it shall be unlawful for anyone operating a taxicab <br /> licensed by the city to charge, demand or receive any greater or lesser rate than the <br /> following: <br /> 1. Taxicab. <br /> a. To be determined by the taximeter: <br /> i. Upon activation of the taximeter, one dollar and sixty cents; <br /> ii. For each succeeding one mile or fraction hereof, one dollar and sixty cents; <br /> iii. For each additional person for the whole journey, fifty cents; <br /> iv. For each minute of waiting time or fraction thereof, fifty cents(thirty dollars/hour). <br /> b. Waiting time shall include the time when the taxicab is not in motion, beginning <br /> with the arrival at the place to which it has been called, or the time consumed while <br /> standing at the directive of the passenger. No charge shall be made for time lost for <br /> inefficiency of the taxicab or its operator or time consumed by premature response <br /> to a call. The above charges shall be for one person. <br /> 17 <br />
