c. Limitation on Wait Time Charges. The charge for waiting time on a taximeter shall <br /> not be utilized when the taxicab is traveling in excess of fifteen miles per hour. <br /> d. The charges herein set forth shall be binding upon the owners and drivers of such <br /> taxicabs and any collection of fares in excess of said rates shall be deemed to be a <br /> violation of this ordinance. <br /> B. Special Service Vehicles. <br /> 1. As a requirement of licensing, a schedule of rates to be charged by the applicant <br /> for a special service vehicle shall be established by the applicant and filed with the <br /> city clerk. <br /> 2. Before putting into effect changed rates a licensee must file the new schedule with <br /> the city clerk at least fifteen days in advance. If the new rate requires adjustment of <br /> the taximeter,the licensee may not use the new rate until the adjustment has been <br /> made and the meter resealed by the city or its agent. The licensee must withdraw <br /> any advertisement of the previous rates before using new rates. The licensee must <br /> post the new rate schedule in compliance with the requirements of this ordinance. <br /> Rates may be changed by filing a new rate schedule with the city clerk not more <br /> than two times during the license year and not sooner than three months after the <br /> most recent previous rate change. <br /> 3. No person owning, operating or controlling any special service vehicle shall charge <br /> a rate different than the rate filed with the city clerk. <br /> C. If demanded by the passenger, the driver in charge of a for-hire vehicle shall <br /> deliver to the person paying for the hiring of same at the time of such payment a <br /> receipt therefor, in legible type of writing containing the name of the owner or cab <br /> name, or the city indicia number, the driver's name and for-hire license number, <br /> and any items for which a charge is made,the total amount paid, and the date of <br /> the payment. <br /> D. With the exception of subsection B of this section which authorizes special service <br /> vehicle licensee,to establish their own rates,the other rates provided for in this <br /> section may only be changed by amendments to this ordinance adopted by the city <br /> council. <br /> E. Rates must be established for: <br /> 1. Initial drop on all trips, including the first one-seventh of a mile of travel; and <br /> 2. Distance based on uniform increments of one-seventh of a mile. <br /> F. Discount Rates. All discounts on fares must be filed with the city clerk setting <br /> forth the conditions that must be met to qualify for the discount. All discounts <br /> must be expressed as a percentage discount of the filed rate. <br /> G. Contract Rates. The rates specified in this section for taxicabs and for-hire vehicles <br /> shall not apply to transportation of persons provided pursuant to a written contract <br /> which establishes a fare at a different rate for specified transportation which has <br /> been entered into prior to the passenger's request for transportation and has been <br /> approved by the city clerk; provided,that no contract may include any provision(s) <br /> the effect of which is to directly or indirectly require exclusive use of the <br /> transportation services of the contracting taxicab or for-hire vehicle.
