Definitions <br /> Section 23. Wherever the words beer and wine are used in this ordinance, they <br /> shall be taken to mean and include beer and wine containing not more than 3.2% of <br /> alcohol by weight or 4% by volume , as legalized by the Federal government. <br /> Advertising <br /> Section 24. It shall be unlawful for any licensed dealer to advertise or use beer <br /> or wine as a leader or premium to be given away with any goods , wares and merchandise . <br /> Penalties for Violation <br /> Section 25. Any person violating any of the provisions of this ordinance shall <br /> be , upon conviction thereof, punished by a fine of not less than One Hundred ( 100.00) <br /> Dollars nor more than Three Hundred ( 300.00) Dollars, or by imprisonment of not less <br /> than 30 days nor more than 90 days , or by both such fine and imprisonment. If the <br /> holder of any beer and wine licenses, or any of his employees, is convicted of vio- <br /> lating any of the provisions of this ordinance, for the first offense , in addition <br /> to any fine or imprisonment, the court shall make an order closing said place of bu- <br /> siness for 30 days, and shall certify said closing order to the Commissioner of Safe- <br /> ty ofJverett , and thereupon the Commissioner of Safety shall direct the police of- <br /> ficers to execute that part of the sentence closing said place of business for 30 <br /> days; and it shall be the duty of the Clerk of the Court in all cases of conviction <br /> for the violation of the provisions of this ordinance , where the judgment of the <br /> Court has been that the place of business be closed for any length of time , to fur- <br /> nish said Commissioner of Safety a copy of said order or judgment. <br /> For a second violation of any of the provisions of this ordinance , in addition <br /> to the fine or imprisonment provided , if the ordinance is violated by the holder of <br /> any license or by any of his employees, the court shall make an order closing said <br /> place of business for three months, and thereupon the Clerk of Court shall furnish <br /> the Commissioner of Safety with a copy of said order, and the Commissioner of Safety <br /> shall proceed as upon conviction for the first violation of this ordinance . If any <br /> employee or any licensed beer and wine dealer is convicted a second time for vio- <br /> lating any of the provisions of this ordinance , the license of said employee shall <br /> be thereupon revoked , and no other license shall ever again be granted to such em- <br /> ployee in any such capacity with any such licensed beer and wine dealer. <br /> For a third violation of any provisions of this ordinance , in addition to the <br /> fine or imprisonment provided herein, if-the ordinance is violated by the holder of <br /> any such license , or any of its employees, the Court shall make an order closing such <br /> -9- <br />
