or in the event that said premises do not comply with the requirements
<br /> of the ordinances relating to buildings and health and sanitation; or
<br /> in the event that all of the requirements of this ordinance relating
<br /> to the business for which a license has been applied for have not
<br /> been complied with.
<br /> Section _1_ _: All applicants for licenses under the provisions
<br /> of this ordinance shall, after filing their applications as required
<br /> by this ordinance, pay the preseribed license fee to the City
<br /> treasurer, who shall thereupon issue to each applicant a receipt,
<br /> stating the name of the applicant, his address, the amount paid, and
<br /> the kind of license applied for. If the license applied for be one
<br /> of the kind specified in Section, of this ordinance, and ' hich can
<br /> be granted by the City Council only, the City Clerk shall not issue
<br /> the license applied for until directed by the City Council so to do,
<br /> in which event, upon presentation of the City Treasurer ' s receipt ,
<br /> the City Clerk shall issue such license . Any license applied for,
<br /> other than the kinds specified in Section 1/. , shall, except as
<br /> herein otherwise expressly provided, be issu d by the City Clerk
<br /> upon presentation of such City Treasurer' s receipt , unless the City
<br /> Clerk after investigation, has good reason to believe that the
<br /> applicant is dishonest or immoral, and desires such license to enable
<br /> him to engage in a dishonest, unlawful, or immoral act , practice
<br /> or enterprise; provided, however, that no license shall be issued in
<br /> the event that the applicant ( if a corporation, any of its officers)
<br /> has ever been convicted of any offense involving moral turpitude
<br /> or an intent to defraud; or in the event that the premises upon
<br /> which the occupation or business for which a license is desired
<br /> do not comply with the requirements of the ordinances relating to
<br /> buildings, fire hazard, health and sanitation. Any applicant dis-
<br /> satisfied with the decision of the City Clerk, in refusing to issue
<br /> a license, may appe 1 to the City Council, whose decision, in
<br /> reviewing the acti of the City Clerk, shall be final.
<br /> Section /frr: In addition to other penalties provided by law,
<br /> the City Council reserves unto itself the right to revoke, or suspend,
<br /> any license issued under the provisions of this ordinance at any
<br /> time, where the same was procured by fraud, or false representation
<br /> of fact, or for the violation of, or failure to comply with, any of
<br /> the provisions of this ordinance by the person holding such license,
<br /> or any of his servants agents or employees, while acting within the
<br /> scope of their employment, or the conviction of the person holding
<br /> such license of a felony or misdemeanor involving moral turpitude
<br /> or an intent to defraud, or the conviction of any of his servants,
<br /> , agents or employees of any felony or misdemeanor involving an
<br /> attempt to defraud committed while acting within the scope of thier
<br /> employment, or if the licensee, any of his servants, or agents or
<br /> if ° employees, while acting within the scope of their employment violate
<br /> any law or ordinance relating to the sale or possession of intoxicating
<br /> liquor, the use, possession, or sale of narcotic drugs, or violate
<br /> any law or ordinance relating to public morality ani decency. 4.t
<br /> least three ( 3) days before revoking any license, the City Council
<br /> shall cause to be mailed, or delivered, to the holder of such license
<br /> at his last known address, a notice stating the Time and place of
<br /> hearing concerning the revocation, at which the licensee shall be
<br /> entitled to be heard and introduce the testimony of witnoeses. The
<br /> action of the City Council relative to such revocation shall be
<br /> final; provided, that whenever any person to whom a license has been
<br /> granted under the provisions of this ordinance, shall be convicted of
<br /> violating any of the provisions thereof, such conviction shall be
<br /> prima facie evidence of facts sufficient to warrant revocation of
<br /> [ .{,' , the license held by such person.
